비영리 기관의 업무표장 등록 활성화 방안에 대한 고찰

A study of measures for facilitating Business Emblem's registration of non-profit organizations - Including result analysis of government funded research institute's Business Emblem utilization -

Business Emblem is a unique system that operates only our country in the world to protect the goodwill of those who engage in non-profit work. Although in early introduction of this system, the number of annual applications was 20-30, in recent years, the number of annual application amounts nearly 600-700. But considering the number of those who engage in a non-profit work domestically, the interest in and utilization of domestic users of that system are a very low level(we can find it well through the analysis of Business Emblem's utilization about the government funded research institutes in National Research Council of Science & Techonology). In my thought, Business Emblem system's low interest and utilities is from this reason that there is a lack of introduction, it's legal defects and the differences of interpretation between courts about the applicable law. Therefore I reviewed the various special provisions and analyzed the legal issues and implications arising from them during the whole period of Business Emblem's application·registration·post registration etc. for finding ways to facilitate Business Emblem system. Through this, I suggest legistrative improvements like a various special provisions and amendment of Trademark Examination Guidelines and administrative improvements for facilitating the Business Emblem system.
