A Study on the Safety system in Framework Act on Consumers

Consumers should consume goods like food or products manufactured by various businesses to maintain and sustain life. However, the consumer safety issue arises if the defects or faults appear from such goods causing damage in their lives, body or property. Therefore, there are always possibility in harm and danger of every consumer’s daily life, so government establishes and operates the legal system to prepare the backgrounds of the regulation to ensure safety and effective implementation. Since Consumer Protection Act established in 1980(revised to the Framework Act on Consumers in 2007), there has currently been consumer safety provisions as a separate chapter named consumer safety, and prepared various systems, such as defect information report system, recall system, harmful information collecting system. Without presence of separate so-called law for Consumer Safety, a few of consumer safety-related sections(provisions) of the Framework Act on Consumers are required to be supplemented, which are contents which could cause confusion in terms or matters related to securing effectiveness. Above all, effective enforcement under the appropriate regulations is necessary to ensure consumer safety. For such effective law enforcement, it is expected that the Framework Act on Consumers could provide important systematic bases and background through supplementation on the problems of the Framework.
