법집행기관의 드론 이용에 관한 법적 쟁점과 입법적 개선 방안

Legal Issues and legislative improvements of Drones used by Law Enforcement Agencies

드론(Drone)은 조종사가 직접 탑승하지 않고 원거리에서 원격조종장치를 통해 조종하거나 또는 미리 입력된 컴퓨터 프로그램을 통해 자율적으로 비행하고 항로를 변경할 수 있는 항공기를 말한다. 제1차 세계대전 직후 군사용으로 개발된 드론은 베트남전을 거치면서 미국의 주도 하에 눈부시게 발전하였는데, 최근 들어 센서와 배터리 기술의 발달에 힘입어 드론은 점차 소형화·대중화되고 있다. 4차 산업을 주도할 첨단과학기술 중의 하나로 거론되고 있는 드론은 다양한 분야에서 그 활용 방안이 모색되고 있다. 2014년 한국과학기술기획평가원은 미래 안전사회에 기여하는 유망기술 중의 하나로 초소형 비행 감시로봇을 선정한 바 있는데, 향후 드론은 범죄예방이나 수사를 위해서도 활발히 이용될 것으로 전망된다. 특히, 소형 드론은 교통체증에 구애받지 않고 신속하게 출동할 수 있고, 넓은 시야각의 확보가 가능하며, 장비 구입비용도 저렴하다는 측면에서 그 활용도가 높을 것으로 평가된다. 반면 법집행기관이 무차별적으로 드론을 이용할 경우 사생활이나 개인정보의 침해 문제가 심각하게 대두될 것이라는 우려도 제기되고 있다. 이에 미국에서는 법집행기관에 의한 드론 사용을 규제하기 위한 입법이 개별 주 차원에서 마련되고 있다. 이 논문은 드론에 대한 법적 문제와 규제 현황을 검토한 후 법집행기관이 드론을 이용할 수 있는 업무 영역을 도출하였다. 또한 범죄수사 과정에 드론을 투입하기 위해 선결되어야 할 법적 쟁점들에 대해 논한 후 입법적 개선 방안을 제시하였다.

A drone is an unmanned aircraft, operated from long distance by a control system or by pre-entered computer program, with autonomous flying abilities and possible to change course in air. Drones which were invented after the First World War for military purposes showed remarkable development through the Vietnam War under the United States. Recently, drones are becoming miniaturized and popularized by the development of sensor and battery technology. On the other hand, in 2014 the Korea Institute of Science & Technology Evaluation and Planning(KISTEP) selected the subminiature flying surveillance robot as one of the promising technology contributing to future safe society. In the future, drones will also be widely used in crime prevention and investigation. In particular, mini drones have high utilization rate because they can fly in the air and move swiftly without being affected by traffic, have a wide range of vision and equipment purchasing costs are low. However, if law enforcement agencies indiscriminately use drones, problems such as invasion of privacy or personal information collection and management can occur. In the United States, legislation controlling the use of drones by law enforcement agencies is being prepared separately by each State. This dissertation discuss the legal issues and legislative improvements of drones used by law enforcement agencies.
