기능적 행위지배의 ‘계속적 영향력’과 범행단계와의 관계

A Study on the Relationship between stage of the crime and ‘continuous influence’ of the functional dominant act

공동정범이기 위해서는 자기 자신의 범행기여분이 타관여자의 범죄행위 몫을 보충해주고, 동시에 역으로 타인의 범행활동을 자기 자신의 범죄행위 몫을 보완하는데 이용해야 한다. 기여행위의 범죄실현을 위한 비중을 인과적 측면에서 따져봤을 때, 실질적으로 공범과의 차별화가 가능하고 전체범죄에 대한 귀속이 가능한 행위라면 정범성을 부여할 수 있음이 원칙이다. 이러한 기능적 행위지배의 의미에 따르면, 실행단계 이전 기여는 서로에게 의존하는 정도가 실행단계에서의 정도와 다를 수 있고 직접적으로 구성요건 실현을 지향하는 위험성이 존재한다고 평가되는 실행의 착수 이후 단계 기여와는 다른 규범적 평가가 가능하다. 물론 이런 이유만으로 단순히 실행단계의 기여로 공동정범의 범위를 제한하는 것 은 문제가 있지만, 단계별로 그 기여행위의 의미는 달리 이해할 필요는 있다. 이를 위해 필자는 실행단계 이전 가담행위가 갖춰야 할 하한선을 제안하여 기능적 행위지 배의 본질적 기여의 해석을 조금 구체화하고자 하였다. 실행의 착수 이전 단계에서 의 기여는 객관적 판단에서 공범과의 분명한 차이가 부족하여 그 외에 추가적인 차별화가 요구된다. 이를 위해 실행단계에서의 기여행위보다 높은 하한선을 설정하여 구분하는 시도를 하였다.

The joint principal offender replenishes other actor’s criminal act with his contribution and the other actor contributes the main crime with the joint principal offender. If we consider the causal importance of individual share, the joint principal offender is different from a complice and belongs all of the crime. This is the feature of co-principal offender. The partial act through preparation stage before the start of execution distincts from the one through practical steps in terms of mutually depenence. The partial act after committing crime has the dangerousness which aims to constituting a crime. So this is not same to partial act through preparation stage before the start of execution. Natually, as the case stands we could not conclude that only partial actor after committing crime can be the joint principal offender. But each partial act must get across differentially. I suggest the lower limit for more detailed interpretation of “essential contribution” at preparation stage before the start of execution. We can’t distinguish clearly between partial act through preparation stage before the start of execution from confederate. So this attempt is meaningful.
