정당의 민주적 운영

A Study on Democratically Controlled Political Parties -Focused on Candidate Selection Process-

오늘날 정당이 민주주의의 실현에 기여하는 역할을 고려할 때 정당의 민주적 운영의 중요성은 아무리 강조해도 지나치지 않을 것이다. 정당의 민주적 운영이라고 하면 다양한 관점에서 파악될 수 있겠지만, 무엇보다 중요한 것은 공천과정에 있어서의 민주적인 절차일 것이다. 이는 주권자 국민의 정치적 의사를 국가의사로 매개시켜주는 정당의 가장 기본적 기능과 바로 직결되기 때문이다. 그러나 그동안 우리 정치권에서 보여주었던 공천과정은 상향식의 민주적 공천절차와는 거리가 먼 경우들이 많았는바, 본고는 이러한 문제인식을 바탕으로 민주적인 정당공천방식에 대한 규범적 규제의 가능성을 검토하였다. 물론 이러한 심각한 문제들을 완벽하게 해결할 수 있는 궁극의 해법을 바로 찾아내기는 어려울 수 있겠지만, 주권자 국민의 의사를 우선적으로 반영해 줄 수 있는 공천시스템의 마련은 향후 우리나라의 정치발전의 밑거름이 될 것이라는 점에서 다양한 방안에 대한 분석은 매우 중요한 의미를 가진다고 본다. 다만 한 가지 분명히 밝혀 두고 싶은 것은 아래에서 검토할 내용들은 민주적 공천절차로서 다양한 방안들이 우리 헌법의 정신과 원칙에 부합되느냐의 관점에서 진행된 것으로, 이를 법제화할 것인지, 법제화한다면 그 중 어떤 방식으로 법제화할 것인지 등에 대해서는 또 다른 검토와 논의가 필요하다는 점이다. 각국마다 국민들의 정치의식이나 정당에 대한 참여가 다르므로 우리나라에 적합한 방안을 찾기 위한 노력을 계속되어야 할 것이다.

It cannot be emphasized enough that democratically controlling political parties is very important, because nowadays political parties’ role is critical to realize democracy. Futhermore, it can be told that one of core tasks of democratically controlled political parties is democratic process of selecting candidate for public offices by political parties, since this task is directly related to the very basic function of political parties as a medium between political intention of people and nation’s policy. But, in Korea, a democratic system for selecting candidates have not been established until now, so this study reviews the possibility of legal regulation to democratic candidate selection system in political parties, such as a bottom-up, secret-ballot election system where members of each party may vote for their preferred candidate.
