지방개발공사의 성장문제와 법제도적 개선방안

Growth problems and improvement measures from a law-viewpoint of local public development corporations in S. Korea

우리나라에서는 지방자치제가 실시된 이후 지방개발공사는 모든 광역자치단체에서 설립되고 있을 뿐만 아니라, 최근에는 심지어 기초자치단체에서도 단독으로 지방개발공사를 설립하려는 움직임을 보이고 있다. 그러나 지방에서 주택수요가 급감하고 있는 현실을 감안한다면 남설 되고 있는 지방개발공사의 성장이 과연 사회 전체적인 측면에서 바람직한 것인지에 대하여 진지하게 재검토해볼 필요가 있다. 본 연구에서 실증적으로 분석한 결과 우리나라에서는 지방자치제가 실시된 1995년 이후 지방공기업은 대폭 증가하고 있으며 그 주된 원인이 지방개발공사임을 알 수 있었다. 같은 기간 내에 국가공기업의 수는 오히려 줄어들고 있는 점을 고려한다면 지방공사 특히 지방개발공사의 무분별한 성장은 문제가 있음을 알 수 있다. 사실상 최근에 설립되고 있는 지방개발공사는 당초의 기대와는 달리 민간의 자본참여 없이 자본금 전액이 지방정부에서 출자되고 있어 지방공사의 설립은 자치단체장이나 지방의원 등 지방 정치권의 의지에 크게 달려 있다고 할 수 있다. 지방 행정에 영향력을 확대하려는 지방정치권은 다른 자치단체에서 설립하면 지역의 여건에 대한 충분한 고려 없이 우리도 해야 한다는 식의 연쇄적 설립 형태를 보이고 있다. 따라서 앞으로 지방개발공사의 설립은 자치단체장에게 위임된 설립권을 행정자치부 ‘지방공기업운영위원회(가칭)’에서 엄격히 심의·의결할 필요가 있다. 이는 국가 공기업을 관리하는 기획예산처의 ‘공기업운영위원회’를 참고할 수 있을 것이다. 그 외에도 가능한 한 생활권이 유사한 광역자치단체에서는 공동으로 광역개발공사를 설립할 수 있도록 노력하고 규모가 작은 자치단체에서는 기존의 지방공단과 지방개발공사를 M&A 하여 규모의 경제성을 살리면서 일반 경영관리비를 줄이는 노력을 하여야 할 것이다. 전자인 광역개발공사는 미국의 단일목적 수행 특별구(Single Purposed Special District)를, 후자인 지방공단과 개발공사를 M&A한 모델은 미국의 상업개선지구(Business Improvement District)의 관리모형을 참고할 수 있을 것이다.

Lots of Local Public Development Corporations(LPDP) have been created in all of the large unit local governments after the implementation of local autonomy system in S. Korea. There, futhermore, are signs of trying to found PLDP in lower level local governments recently. We figured out that the number of national public corporation has been decreased, but that of local public corporation, especially LPDP, has been increased rapidly during the same period in this empirical study. The reason of LPDP growth lies in the ownership structure which local government invests a hundred percent without any private sector's participation. It make the local political circles especially Mayor and assemblymen who exhibit a tendency to have their influence on them to establish LPDP. . We recommend that the right of LPDP foundation should be shifted to the competent department form local government to prevent indiscreet creation of LPDP according to the taste of the local political circles. In addition, LPDP in large unit local governments needs to bench-mark Single Purposed Special District in U. S. to step up the scale of economy and LPDP in lower level local governments could refer to Business Improvement District model for the M&A.
