국민의 사법행정 참여 방안에 관한 연구

A Research on Measures for Encouraging Participation of the Public in Judicial Administration

본 연구는 2012년부터 운영되고 있는 새로운 사법행정 참여기구인 시민사법위원회와 시민사법참여단의 현황을 살피고 미국 제도를 중심으로 참고하여 국민의 사법행정 참여 제도의 발전 방안을 모색하기 위한 것이다. 본 연구에서는 국민의 사법 신뢰 증진과 법원과 국민 간 협력 및 소통 강화 차원의 ‘국민과 함께하는 사법행정’을 위하여 사법행정 참여의 체계화, 실용화, 전문화, 정착화 측면에서의 정책적 제언을 제시하였다. 구체적으로는 분과위원회·운영위원회의 활성화, 구성원 다양화 및 소수자 배려, 온라인 자문 및 토론 환경 구축, 사법서비스의 이용자·담당자·사법행정 참여기구의 구성원을 대상으로 한 심층 인터뷰를 통한 개선 과제의 발굴, 분과위원회 중심의 세부 과제 수행, ‘사법 발전 프로젝트’의 시범 실시, 업무 담당자 연수 프로그램, 업무 가이드라인 제정, 연구 커뮤니티 개설, 사전 오리엔테이션 자료 개발, 예산의 안정적 확보, 법제화 논의 등을 제안하였다. 나아가 법원과 국민 간 발전적 협력 관계의 정립을 통한 제도의 발전 전략 계획 수립을 위한 기본 방안 및 2015년부터 2017년까지의 3개년 세부 실행 계획의 구상안을 제시하였다. 본 연구가 시민사법위원회, 시민사법참여단의 운영 방식 개선에 관한 정책자료로 널리 활용되고 국민의 사법행정 참여에 관한 이론적, 실천적 논의의 확장에 기여하기를 기대한다.

The focus of this research is to review the development and current state of citizen participation in the judicial administration in Korea and the operation of court and community collaboration in US and, based thereon, explore the areas where ‘citizen judicial council’ and ‘citizen judicial participation organization’ can be improved and propose viable policy alternatives. This research makes a series of proposals on how to improve the mechanisms ensuring a representative and comprehensive dialogue between the court and the community from the standpoint of systematization, implementation, specialization and consolidation. The main suggestions are the activation of sub-committee and steering committee, diversification, website for on-line advice and debate, issue-finding through in-depth interviews for court users, staffs and participants, program for staffs, guideline for management, on-line community, orientation. I hope that this research will contribute to planning, implementing and maintaining citizen participation in the judicial administration in Korea.
