법관의 초 · 중 · 고등학생을 위한 수준별 강의안에 관한 연구

Research on Different Level Lecture Programs Conducted by Judges for Elementary, Middle, and High School Students

사법부 법교육의 하나로 학생들을 대상으로 하는 법관의 강의가 증가하고 있고 중요성이 강조되고 있다. 학생들을 대상으로 한 법관의 강의는 학생들에게 법제도와 법현상에 대한 이해를 통해 법적 문제를 합리적으로 판단하고 해결할 수 있는 능력을 갖추도록 하는한편, 교과서 등에서 간접적으로 접한 내용을 법관을 통해 생생히 확인할 수 있도록 하는 점에서 중요한 의미를 갖는다. 법관의 강의는 학생들로 하여금 법에 대한 부정적 인식이나 오해를 극복하도록 하고 사법제도에 대한 올바른 인식과 이해를 통해 법원을 신뢰할 수 있도록 하는 점에서도 중요하다.이 연구에서는 법관 강의의 중요성과 필요성을 반영하여, 법관이 초등학생, 중학생, 고등학생을 대상으로 법교육 관련 강의를 하는 데 필요한 강의안을 개발하는 것을 목표로 하였다. 특히 이 연구에서는 강의 대상자인 학생의 법교육 관련 수준을 가늠하는 한편 수준에맞는 강의주제와 내용을 개발하는 데에 중점을 두고, 이를 위해 법교육의 내용을 살펴보고 초·중·고등학교의 법교육 관련 교과서와 법교육 교재 등의 내용을 두루 검토하였다.이러한 과정을 거쳐 초등학교 4~6학년용, 중학생용, 고등학생용 강의안을 개발하였다.기본적으로는 법교육의 핵심적인 내용을 반영하면서도 수준별로 강의주제를 달리 구성하여, 초등학생용 강의안은 법제도에 대한 기초적인 이해와 법의식의 함양에 중점을 둔 22개의 주제로, 중학생용 강의안은 사법제도에 대한 전반적인 이해에 중점을 둔 26개의 주제로, 고등학생용 강의안은 분쟁해결능력의 증진과 사법제도와 절차의 올바른 이해에 중점을 둔 31개의 주제로 구성하였다. 기본형 외에 강의주제를 축소한 여러 형태를 제시하여 강의시간에 따라 탄력적인 강의가 가능하도록 하였다.강의안은 법관이 편리하게 활용할 수 있도록 파워포인트 형식의 자료를 제공하는 한편,강의내용, 핵심 단어, 교과서 관련 단원, 해설로 구성된 별도의 책자로 제작하였다.

Judges’ lecture is an important and effective law related education method for elementary,middle, and high school students. It equips students with the knowledge and skill pertaining to the law, the legal process, and the legal system. It helps students develop conflict resolution skills as well as legal listening, speaking, and thinking ability. Furthermore, it fosters a better appreciation of the judicial system and promotes future generation’s trust in the Korean judiciary.The purpose of this research is to develop level-based syllabi in the lecture programs conducted by judges for elementary, middle, and high school students. Especially, this research focused on measuring the level of students and selecting topics and contents according to the level.Through this research, 3 level-based syllabi for elementary(4th~6th grade), middle, and high school students have been developed.Each syllabus reflected the significant contents of the law related education, yet the topics are configured differently according to the level.The lecture for elementary schoolstudents consists of 22 topics focused on the basic understanding of the legal system and promoting the law-abiding spirit.The lecture for middle school students consists of 26 topics focused on the general understanding of the judicial system.The lecture for high school students consists of 31 topics focused on improving the dispute resolution ability and the right understanding of the judicial system and the judicial process.Each syllabus includes desirable lecture methods, powerpoint presentations, lecture contents, key points, relevant units of textbook, and explanations.These lecture syllabi will do much to contribute to the judicial branch’s law related education for elementary, middle, and high school students.
