중·고등학생을 위한 법원체험 프로그램에 관한 연구

Research on Court Experience Programs for Middle and High School Students

법원체험은 청소년들에게 각별한 의미가 있다. 교과서 등의 책을 통해 배우거나 접한 내용을 법원에서 실제로 경험하고, 재판이나 법원의 기능과 역할을 생생히 배우고 익히는 과정은 교육 효과를 증진하고 청소년들의 진로 선택에 상당한 도움을 주게 된다. 청소년들은 법원을 자주 접하고 체험하는 과정을 통해 법에 대한 부정적인 인식이나 오해를 극복하고,사법제도에 대한 올바른 인식과 이해를 통해 법원을 신뢰할 수 있게 될 것이다. 현재 학생들의 법원체험은 새로운 국면을 맞고 있다. ‘중학교 자유학기제’의 시행에 따라 법원체험 프로그램에 대한 수요와 관심이 급증할 것으로 예상되기 때문이다.이 연구에서는 법원체험의 중요성과 필요성을 반영하여, 중학생과 고등학생의 법원체험 에 필요한 프로그램을 개발하는 것을 목표로 하였다. 이를 위해 법원체험과 관련된 중·고등학교 교육과정과 교과서의 내용을 검토하여, 법원체험에는 법교육과 진로교육 관점에서의 접근이 필요함을 확인한 후 법교육과 진로교육의 내용, 특징과 방법을 살펴보았다. 그리고 현재 시행하고 있는 국내외 법 관련 프로그램의 내용을 검토하여 시사점을 도출하였다.이러한 과정을 거쳐 일선 법원에서 활용할 수 있는 법원체험 프로그램의 유형과 소재 및 진행 방법을 제시하였다. 프로그램은 교육과정과 목적에 따라 법교육형과 진로교육형으로, 기간과 형태에 따라 반일형, 1일형, 2일형, 캠프형으로, 횟수에 따라 처음 방문형과 재방문형으로 구별하였다. 그리고 프로그램의 내용을 청사 견학, 법원 관련 동영상 시청, 법원과 재판에 관한 법관의 강의, 재판 방청, 업무 참관과 인터뷰, 법 관련 퀴즈, 토론과 토의, 발표하기, 그림 그리기 등, 법 관련 영화·드라마 시청, 모의재판, 모의 조정, 법관 업무 체험, 역할 놀이, 법률 서식 작성, 규칙 만들기, 전자소송 체험 등으로 구성하고, 구체적인 소재와 진행 방법을 제시하였다.

Court experience plays an important role for students. It equips students with the vivid knowledge and information about the law, the judicial process, and the judicial system. It helps students not only to develop legal listening, speaking, and thinking ability but also to learn about career opportunities. Furthermore, it promotes future generation’s trust in the Korean judiciary. Meanwhile, the demand and interest in court experience programs have been increasing in accordance with the enforcement of ‘free term system’ in middle school. The purpose of this research is to develop court experience programs for middle and high school students. Especially, this research focused on measuring the level and curriculum of students that take part in court experience programs and composing types, topics, and contents of the programs. This research suggested various programs. The programs are classified into law-related education type and career education type according to the curriculum and purpose. Also, they are classified as half-a-day type, one-day type, two-day type, and vacation camp type according to the period and form; first visit type and revisit type according to the number of visiting. This research suggested contents and materials of the programs. These contents consist of courthouse tour, watching the court videos, judge’s lecture, trial observation, meeting judges and court staff, quiz, debate and discussion, speaking, drawing pictures, watching law-related movies and dramas, mock trial, mock mediation, experiencing judge’s work, role-playing, writing legal documents, creating rules, and experiencing electronic litigation. These various programs and contents will contribute to the judicial branch’s law-related education and career education for middle and high school students.
