미국 연방대법원 판결의 유형과 사회적 영향에 대한 연구

Research on the Categorization and Social Impact of the United States Supreme Court Decisions

미국 연방대법원(United States Supreme Court)은 일반 소송사건의 최종심일 뿐만 아니라 위헌심사권까지 보유하는 명실상부한 미국의 최고법원으로서 역사적으로 상당한 영향력을 행사해왔다. 특히 미국 연방대법원은 상고허가제를 채택하여 발전시킨 결과 중요한 쟁점을 제시하는 사안에 대해서만 상고를 선별적으로 허용한다. 이로써 미국 연방대법원이 소수의 핵심 사건에 대법관들의 역량을 집중시킬 수 있고 이로 인하여 개별 판결의 무게와 사회적 영향이 극대화될 수밖에 없다. 실제로 미국의 역사에서 시대마다 다양한 이해집단들 간에 첨예하게 대립하던 사회적 쟁점에 대하여 연방대법원은 헌법 및 법률에 대한 최종적인 유권해석으로 시민들의 의식과 사회 전반의 변화를 촉진해왔으며, 이를 바탕으로 삼권분립의 한 축을 담당하는 사법부로서 국민의 신뢰를 받아왔다. 이처럼 사회발전의 정도와 방향에 크게 기여한 미국 연방대법원 및 그 판결을 연구하는 것이 이 연구보고서의 목표이다. 이를 위하여 연구보고서는 우선 미국 연방 대법원의 역사 및 제도를 개관하고 상고허가제도의 특성을 자세히 검토한다. 심리·판단 대상의 선정 기준과 선정 과정에 영향을 미치는 요소들을 살펴봄으로써 미국 연방대법원이 어떤 이유에서 그리고 어떻게 사건이송을 명령하는지 알아본다. 그후 다양한 기준에 따라 미국 연방대법원의 판결을 유형화하고 대표적인 판결들을 집중적으로 분석한다. 연방대법원의 판결이 갖는 영향에 대한 다양한 이론을 살펴본 후 개별 판결이 구체적으로 연방 및 주(州) 입법부와 행정부 그리고 미국 사회 전반에 어떤 영향을 미쳤는지 검토하고자 한다. 특히 연방대법원과 입법부의 관계를 살펴보기 위해서 ‘반다수주의적 난관(countermajoritarian difficulty)’의 문제도 조명한다.

As the highest federal court in the nation the United States Supreme Court enjoys con- siderable influence in determining the direction and extent of socioeconomic and political development in America. A key to the Court s authority and influence lies in the granting of petitions for certiorari in a limited, yet flexible manner. Through this the justices of the Court are able to focus their time and resources on cases of paramount importance to the nation as a whole. An overview of American history reveals how decisions made by the Court resolved conflict among various interest groups in the American society and how as a result the federal judiciary gained the confidence of the American people. In order to understand the ramifications and effect of the decisions of the Court on soci- ety in America this research proposes to examine the history and characteristics of the in- stitution of the Court. Also the writ of certiorari is studied in detail, with particular em- phasis on the determining factors that play a crucial role in granting (or denying) certiorari. Afterwards the Court s decisions are categorized into different groups with some of the most influential and authoritative cases from each group being analyzed extensively. Through this the present research examines how individual decisions of the Court have influenced (and continue to affect) the legislative and administrative branches both on the state and federal levels, as well as the general public and society. In particular, special at tention is given to the question of ‘countermajoritarian difficulty’, so as to provide insight into the nature of the relationship between the Court and Congress.
