미국의 아동학대 수사절차상 피해자 보호 및지원에 관한 연구

A Study on Protecting and Supporting Victims of Child Abuse in Criminal Procedure in the United States

Although there are a number of institutional activities respond to child abuse in Korea, it seems to be not enough. With creation of the federal Children’s Bureau in 1912 in the United States, there have been developed on the issues about child development and welfare. Accordingly, this study offers development strategy for Korean system focusing the protecting and supporting victims of child abuse in criminal procedure in the United States. First, it needs to be reinforced by a multidisciplinary respond. Second, it needs to define roles according to each agency mandate and share information associated with child abuse cases. Third, there is a need to expand the rights of Child Protection Agency only for protecting victims of child abuse. Fourth, there is a need to appoint a guardian ad litem obligatory to represent the child’s best interests in every case of abuse that results in a judicial proceeding. Fifth, It needs to expand mandatory reporters, strengthen punishment in case any person who shall knowingly fail to make the report required by law, and reinforce of public education and public relations. Lastly, it needs to assist family depending on quality.
