대통령과 국회의 협의를 통한 민주적 조약체결절차 구체화 방안

Specific Plans for a Democratic Treaty-making Process through Cooperation between the President and the National Assembly

우리 헌법상 조약체결에 관한 대통령(정부)과 국회의 권한배분구조 및 관련 조문의 해석상 조약체결권은 대통령과 국회의 합수적 권력으로 이해할 수 있고, 따라서 조약체결절차는 대통령과 국회의 협의를 바탕으로 민주적 의사형성과정을 확보할 수 있도록 구체화되어야 한다. 국제적 합의를 위한 상대방과의 교섭과정은 대개 매우 복잡하고 민감하기 때문에 교섭이 이미 진행되기 시작한 단계에서 국내적인 문제를 발견할 경우 이를 해결하는 것은 현실적으로 상당히 어려울 것이므로, 국내적 준비단계에서 충분히 논의하고 검토하는 것이 중요하다. 국제적 합의는 법치국가의 원리에 따라 해당 합의의 내용에 적절한 형식으로 이루어져야 하고, 그 합의가 갖게 될 국내법적 지위에 적합한 성립절차를 거쳐야 한다. 국제적 합의의 합의 형식을 결정하는 기준은 의회유보의 원칙과 본질성이론이며, 이를 결정하는 주체는 대통령과 국회이다. 두 기관은 국내적 준비 및 계획 단계에서부터 협의를 통해 향후 추진할 합의 내용의 국내적 영향을 검토하여 합의 형식을 택하고, 그에 적합한 체결절차를 거칠 수 있도록 해야 한다. 이 논문은 조약체결에 관한 의사의 형성 및 결정절차를 국내적 기본방향 설정 단계, 조약 내용의 구체적 형성 단계(교섭 진행 단계), 조약의 확정 및 이행 단계로 나누어 각 단계별로 대통령과 국회 간 협의의 의의와 구체적인 협의 방안을 논하고, 현재 시행 중인 「통상조약의 체결절차 및 이행에 관한 법률」과 지난 7월 15일에 발의된 「조약의 체결·비준에 관한 민주적 통제를 위한 법률안」의 내용을 단계에 따라 검토하여 이에 대한 평가와 대안을 제시하였다.

This article is based on a new constitutional approach to the powers through focusing on treaty issues on the basis of the dynamic understanding of separation of powers. As a positive matter, treaties have the same force as legislation by generally affecting people’s daily life in terms of rights and duties, and as a normative matter, Article 6 of the Constitution declares that they shall have the same effect as domestic laws without further legislation in the National Assembly. Therefore, the National Assembly has the power to fundamentally form and meticulously review treaties that are effective as domestic laws. The treaty-making process is the joint action both of the executive branch and the legislative branch, so both branches share treaty powers to be cooperatively exercised. It is interpretatively reasonable that President has treaty powers based on the executive perspectives, and on the other, the National Assembly has the powers based on the legislative aspects. Under the arguments above, this article suggests cooperative plans through focusing on National Assembly’s power to form and review treaties. The plans are shaped up stage by stage as follows: ① Establishment of Domestic Action Plans, ② Negotiation, ③ Domestic Procedures after Negotiation, ④ Domestic Implementation, ⑤ Revision and Termination of Treaty.
