헌법상 건강권의 내용과 식품안전의 보장

The Contents of Right to Health in Constitution and Guarantee of Food Safety

오늘날 사람들은 보다 건강한 삶을 위해 건강관리에 많은 관심을 기울이고 있으며, 특히 안전한 먹거리에 대한 관심과 수요가 증대되고 있다. 왜냐하면 식품을 통한 영양분의 섭취는 인간이 건강한 삶을 유지하는데 있어 매우 중요한 생명유지활동이기 때문일 것이다. 우리 헌법은 건강권을 명시적으로 규정하고 있지 않으나 인간의 존엄과 행복추구, 인간다운 생활을 할 권리, 보건권 등을 통하여 이를 보장하고 있다. 그런데 이러한 국민의 건강권은 그 의미와 근거, 국가의 보호정도에 대해서 구체적인 해석의 기준이 미흡한 것이 사실이다. 특히 오늘날 식품가공기술의 발전과 유통·판매과정의 세분화, 식품첨가물의 사용증가, 외식 및 급식의 증가, 식품류의 수입증가 등의 원인들로 인해 식품안전을 보장하는 것이 매우 어렵게 된 것이 사실이다. 그러나 식품은 인간이 생존하기 위해 필수불가결한 것이고, 인간의 생명과 신체에 중대한 영향을 미치는 것이므로 식품이 생산되어 소비되기까지 식품안전을 보장하는 것은 국가의 중요한 책무이다. 즉, 식품의 안전은 국민의 생명과 신체의 안전을 지키기 위해 필수적인 것으로 국가는 국민에게 안전한 식품을 공급하기 위해 최선을 다해야 할 의무가 있다. 이런 측면에서 볼 때, 안전한 먹거리에 대한 관리는 국가의 중요한 책무가 아닐 수 없으며, 국민의 건강권은 중요한 기본권이 아닐 수 없다.

These days, people show much interest in health care for better life. Especially, there are increased interest and demands for safe foods, maybe because intake of nutrition through foods is a very important activity for people to maintain a healthy life. The Constitution of the Republic of Korea does not explicitly stipulate a right to health, but, guarantees it through the rights to human dignity, pursuit of happiness, living worthy of human dignity, and public health. However, in fact, the Constitution lacks specific standards of interpretation on the meaning, grounds, and degree of protection by the government of the right to health. In particular, it has become very hard to guarantee food safety because of development of food processing technologies, division of distribution and sales processes, increased use of food additives, and increase in eating out, food services, and imported foods. However, foods are inevitable for survival of humans and have a great impact on the life and body of humans. Thus, it is an important duty of the government to guarantee food safety in the processes from production to consumption of foods. That is, since food safety is an essential element for keeping the safety of life and body of the people, the government has a duty to do its best to supply safe foods to its people. In this connection, control of safe foods is a crucial obligation of the government, and the right to health of the people is one of the critical basic human rights.
