This article focuses on the liability and obligation of non-documentary conditions in letters of credit. The purpose of this study is to examine the bank’s liability and court’s obligation on the non-documentary conditions under letter of credit transactions. A non-documentary conditions is a condition contained in the credit without any reference to the presented document. So they are causing many problems to all parties involved in letter of credit transactions. The purpose of this study is a bank’s liability and court’s obligation on the non-documentary conditions under Letter of credit transactions. The result of this study can be summarized. UCP, ISP98, CIGSLC and UCC stipulate which banks will disregard non-documentary conditions. Also courts used to permit the effect of non-documentary conditions. Finally, The parties should not attempt to put in non-documentary in the letter of credit.
