UN 아동권리협약의 변천과 한국의 이행 성과와 과제

Changes in the United Nations convention on the rights of the child and results of implementation and tasks of South Korea

이 연구는 아동권리협약의 근간인 CRC, 제1 2선택 의정서(2000)와 제3차 선택 의정서(2011) 등 아동권리 보장에 대한 국제적 협약의 주요 내용과 시사점을 살펴보고, 아동권리 보장관련 국제협약에 대한 한국의 이행성과와 과제를 탐색해 보고자 하는 목적으로 수행되었다. 이 연구의 주요 연구결과는 다음과 같다. UN아동권리협약은 크게 두 단계 즉, 국제적 아동권리보호 인식 확산단계에서 국제적 아동권리 보호실천단계로 변천하였다. 그리고 아동권리 보호실천단계는 아동권리보장 정비단계에서 아동권리 청원단계로 변천하였다. 한국은 UN아동권리협약과 제1 2차 선택 의정서에 비준을 통하여 다양한 아동 권리보호를 위한 제도와 법령정비를 하였다. 그러나 아동권리협약 제40조 (b)-5항 상소권 보장은 여전히 유보상태에 있으며, 제3선택의정서는 아직 비준을 하지 않고 있다.

This study has been performed to check main contents and implications of international conventions on the assurance of the rights of the child such as UN CRC and its optional protocols and also to search the results of implementation and tasks of Korea about the International Conventions on the assurance of the rights of the child. UN CRC mainly have been changed with two stages–in other words, from the stage of international spread of cognition about protection of children’s rights to the stage of international fulfillment of protection of children’s rights. And the stage of international fulfillment of protection for children’s rights has been changed from the modification stage of assurance of the rights of the child to the stage of petition for the rights of the child. Korea has made reorganization of the system and maintenance of legal regulations for protecting various rights of child through the ratification of Optional Protocol to the CRC on the sale of Children, child prostitution and child pornography, and Optional Protocol to the CRC on the involvement of children in armed conflict(2000). However, ensuring the right of the appeal, the Clause (b)-5 of Article 40 of the CRC is still under deferral situation, and Optional Protocol to the CRC(2011) to Provide a Communication Procedure has not yet been ratified.
