다중흐름분석을 적용한 가정폭력방지 정책변동에 관한 연구

A study on Policy Change Process of the Prevention of Domestic Violence : An Application of Kingdon s Multiple Streams Model to the Formation of Police

이 연구의 목적은 정책형성과정의 비순차성과 비합리성을 강조하는 킹돈의 다중흐름모형을 적용하여 경찰의 가정폭력 개입방침 변경을 위한 정책형성과정을 분석한 후, 정책변동차원에서 2007년과 2011년에 있었던 법안개정 논의과정을 비 교․평가하여 향후 정책적 시사점을 탐색해 보는 것이다. 이를 위해 2011년 가정폭력범죄의 처벌 등에 관한 특례법에 신설된 경찰의 긴급임시조치권을 정책산출물로 상정하였고, 이 긴급임시조치권이 법제화될 때까지 일반에 공개되었던 정부정책자료, 신문기사, 관련지표, 경찰청 통계자료, 국회 의 안정보시스템 법률안, 국회 회의록 등의 자료를 수집하여 분석하였다. 분석결과, 경찰의 긴급임시조치권이 법제화되는데 있어 상대적으로 큰 영향력을 끼친 흐름은 ‘정치의 흐름’과 ‘정책대안의 흐름’인 것으로 파악되었다. 그리고정책형성과정에서 정책선도자로 출현한 여성가족부가 정책변동에 중요한 영향을 미쳤고, 정책선도자의 정치적 교섭력과 집요한 노력이 결합하여 정책변동을 촉진시킨 것으로 확인되었다.

The purpose of this study is to analyze the policy formulation process concerning the police s early intervention with domestic violence cases and to evaluate the legislation amendment cases in both 2007 and 2011 in the context of policy change with an application of Kingdon’s multiple streams model as an analytical framework. For this study, the police’s urgent ad hoc measures stipulated in 2011 by act on special cases concerning the punishment, etc, of crimes of domestic violence were assumed as the policy output. I utilized the data including government documents, newspaper articles, related statistics, press released by ministry of gender equality and family, and related bills, which were released to the public from 2000 to 2010. I found that a combination of political stream and policy stream had a strong influence on the legislation of the police’s urgent ad hoc measures in 2011. I also recognized that the policy entrepreneur played a significant role in formulating the policy change and that policy entrepreneurs’s political connection contributed greatly to promote the policy change together with entrepreneurs’s sheer persistence.
