노인범죄에 대한 치안대책

A study on the Causes and Measures of Elderly Crime

초고령 사회로의 진입을 앞두고 있는 우리사회는 고령인구의 증가로 많은 사회문제를 경험하고 있다. 다양한 사회문제 중 하나로 노인범죄 문제는 더욱 심각해지고 있는 추세이다. 이 연구는 기존에 사회적 약자로서 노인을 범죄의 대상으로 만 파악하던 관점에서 탈피하여 범죄주체로서의 노인 즉, 노인범죄에 대해 실태와 원인을 살펴보고, 이를 바탕으로 노인범죄에 대한 대책을 모색해 보고자 하였다. 노인범죄의 원인에 관하여는 문헌연구를 실시하여 기존의 선행연구를 검토하 였으며, 노인범죄의 실태는 2014년 대검찰청 범죄분석을 활용하여 기술통계분석을 실시하였다. 연구결과 노인범죄의 주요원인으로는 경제적 요인, 신체적 요인, 가정적 요인, 심리적 요인, 성적 요인 등이 존재하는 것으로 파악되었으며, 노인범죄는 지속적으로 증가하고 있는 것으로 분석되었다. 또한 범죄의 양상도 기존의 재산범죄, 경 미한 폭력범죄의 형태에서 살인, 강간 등으로 흉포화되어 가고 있는 것으로 분석되었다. 노인범죄에 대한 대책으로는 노인범죄에 대한 형사사법기관의 관심전환, 노인 범죄에 대한 전문수사관의 양성을 통한 수사역량의 강화 및 유관기관과의 협력치안체계 확립 등을 제시하였다. 이 연구는 노인범죄의 원인에 대한 실증적 검토를 하지 못했다는 점은 한계이지만, 초고령 사회로의 진입을 앞두고 있는 상황에서 노인범죄에 대해 관심을 기울이고, 대응방안을 제시하고 있다는 점에서 의의를 찾을 수 있다.

As South Korean society advances to aging society, various social problems are emerging due to higher aging population. One of these exacerbating problems is crime on the elderly. This study avoids the current perspective that sees the elderly only as vulnerable victims, and rather focuses on crimes perpetrated by the elderly. This study examines the characteristics and current status of the problem, and seeks policy alternatives based on results of the analysis of this problem. Previous literature on the causes of elderly crime was conducted, and current status of elderly crime was examine through descriptive analysis of data from the Prosecutor’s Office from 2014. Results show main causes of elderly crime are economic, physical, domestic, psychological and sexual factors, and analysis show elderly crime is persistently increasing. Also, type of crime perpetrated is becoming more severe, shifting from property crime and minor assaults to homicide and rape. This study proposes that criminal justice institutions shift their attention to elderly crime, strengthen investigative abilities by training professional investigators on elderly crime and establishment of cooperative system between relevant institutions. This study is limited in the sense that there was no empirical analysis, but this study contributes to the academia by proposing new policy alternatives in facing a new social trend, an aging society.
