헌법상 지방정당의 역할과 보장

Local Parties in Constitutional Perspective

한국 정당내부의 민주주의가 정착되지 못한 것은 고도로 중앙집권화된 전국정당의 영향력에 말미암은 바가 크다. 헌법은 지방자치제도를 헌법적으로 보장하고 동시에 자유민주주의의 핵심적 가치로서 복수정당제도를 보장하고 있다. 이런 헌법정신으로부터 정당제도와 지방자치제도는 상호결합되어야 한다. 전국을 조직단위로 전국정당화를 지향하고 있는 현행 정당법은 헌법의 지방자치제도와 복수정당제의 요구를 실현하는데 일정한 한계를 보인다. 전국을 조직단위로 하지 않고 또한 다수의 당원요건을 구비하지 못한 지방정당 혹은 소규모 정당 역시 헌법상의 정당으로 인정되어야 한다. 지방정당은 지방자치의 선거에 주도적으로 참여하여 지방선거에서 경쟁적 구도를 실현하고 나아가 그 조직범위를 넓혀 전국정당을 지향하여야 한다. 독립성을 갖춘 지방정당을 통해 공직후보자들이 리쿠르트되는 구조를 만들어야 한다. 정당은 지방의회의원, 지방자치단체장, 지역구 국회의원, 도지사, 그리고 공직의 정점인 대통령으로 이어지는 공직의 사다리를 제시하며 공직후보자들의 야망을 자극하면서 이들을 정당의 후보로 추천해야 한다. 헌법이 보장하는 지방자치와 정당의 결합을 통해 지역정치에서 정당의 역할이 강화되고 이런지역을 중심으로 전국으로 확산되는 튼튼한 조직력과 세계관을 갖춘 정당이 전국정당이 되어야 우리 민주주의가 보다 더 다원적으로 국민의 이해를 대변할 수 있고 정당 내부의 민주주의도 가능할 수 있다. 그런데 현행 정당법은 정당등록의 요건으로 너무 강화된 전국적 조직을 요구하고 있어 아래로부터의 정당정치의 출발을 제약하는 것이어서 이는 헌법이 보장하는 정당설립의 자유를 심히 제한하는 것이라는 점에서 정당등록과 그 취소요건의 완화가 필요하다.

The centripetal characteristic of Korean Political Party system has made the democracy of party weak. Korean constitution guarantees not only the local autonomy system(§117; §118), but also plural party system(§8). So it is imperative for two systems to be combined in order to guarantee the spirit of constitution. According to Korean Political Party law, political party should have at least 5 nation-wide local(province or great city) organizations each of which should has more than 1,000 party members. Local party or small party that does not achieve this requirement can not work as a political party. So Korean Political Party law has hindered the meaningful development of Local Autonomy and Plural Party System. Local party should become national party in the future which has nation-wide organizations according to Korean Political Party law, taking part in local election actively. In addition, local party establish a recruiting channel for public official all over the country. Party should recommend public office candidate in the name of party in the advent of election showing the candidate the ladder of public office. The role of local party in local politics is very important. Independence of local party is essential for the inner democracy of political party. Finally, it is necessary Korean Political Party law should be amended for the advent of local party in local politics. Strict registration requirement on party organization and party member should be abolished as soon as possible.
