국제무역거래에서의 권리포기 선화증권 활용상의 한계성에 관한 연구

Limitations in Using Surrender B/L in International Transactions

목적지에 선화증권 보다 물품이 먼저 도착하여 물품의 인수도와 관련하여 운송인과 수화 인간 여러 문제를 발생시키는 선화증권의 위기문제를 해결하기 위해 권리포기 선화증권이 사용되고 있다. 권리포기선화증권의 경우 선화증권이라는 명칭으로 사용되고 있지만 선화증권에 대한 권리를 포기하고 선화증권 원본이 선적지에서 회수된다는 점에서 정식 선화증권이라고 보기 어려운 점이 있으며 특히 송화인과 수화인 그리고 운송인 간에 화물의 손상이나 멸실 등의 이유로 법적 분쟁이 발생했을 때 화물의 소유권이나 소송권리 등과 같은 문제가 발생할 소지가 있다. 따라서 본 연구에서는 권리포기 선화증권의 사용으로 발생한 분쟁에 관한 판례를 분석하여 권리포기 선화증권의 법적 효력을 살펴봄으로써 권리포기 선화증권 이용상의 한계성을 살펴보고자 한다. 특히 선화증권 위기의 문제가 주로 근거리 운송에서 빈번히 발생하는 문제인 만큼 한 ․중 ․일에서의 권리포기 선화증권의 사용으로 인하여 발생한 사건의 판례를 중심으로 분석함으로써 실무적으로 법적 문제와 관련된 한계성을 제시하여 권리포기 선화증권의 이해를 제고하는 것을 그 연구목적으로 한다.

Purpose : The purpose of this paper is to contribute to enhancing the understanding of Surrender Bill of Lading which is used as a method to take delivery of the goods at destination without original Bill of Lading as document of title. Research design, data, methodology : This paper is composed of five chapters. Chapter Ⅰ deals with the introduction of this paper and Chapter Ⅱ explains the previous studies and the definition and uses of surrender B/L. Chapter Ⅲ deals with the cases of surrender B/L and Chapter Ⅳ deals with limitations in using surrender B/L in international transactions. Chapter V concludes this paper. Results : This paper finds limitations in using surrender B/L in international transactions as follows; i) absence of legal background of surrender B/L, ii) doubt of legal effects and title transfer in using surrender B/L, iii) different decisions depending on types of issuance of surrender B/L and different decisions depending on the jurisdictions of cases. Conclusions : This paper concludes that surrender B/L should be used with caution as surrender B/L has limitations owing to its’ legal problems and unsettled practice.
