선거운동 규제의 개선방안에 관한 몇 가지 고찰

A Study on Plans to Improve Election Campaign Regulations - From the perspective of the expansion of freedom and open competition -

헌법상 선거제도는 대의민주주의와 의회제도의 성공적인 운영을 위해 중요한 요소로서 선거운동의 자유와 선거의 공정성을 공히 그 핵심적인 가치로 한다. 양자를 동시에 조화롭게 구현해내는 것이 가장 바람직하기는 할 것이나 실제로 그렇게 해내는 것이 반드시 용이한 것은 아니다. 선거현실에서 경험되고 예상되는 여러 부정적인 현상에 대처하고 그 발생을 억지하면서 선거의 공정성을 확보하기 위해서 현실적으로 선거운동에 대한 일정한 규제가 불가피하다고 여겨져 왔다. 그리고 이러한 판단의 정당성을 뒷받침할 만한 현실적인 사정이 없다고 할 수도 없었던 것이 그간의 실상에 가까웠다고 할 것이다. 그러나 시간의 흐름 속에서 사람들의 생활관습과 가치관은 물론이고 과학기술의 발전을 통해 문명의 양상이 크게 변화를 겪게 되었다. 이에 따라 선거 영역에서도 문제를 바라보는 새로운 시각과 관점을 가능하게 해주는 토대가 마련되어가고 있다고 본다. 종래선거운동의 자유를 보장하는 것이 헌법적으로 중대한 의의를 지니고 있다는 점을 인식하면서도 역사적인 체험을 통해 확인되는 현실적인 문제점들에 대한 우려로 인해 그러한 의의를 충분히 구현해내기가 쉽지 않았다고 할 수 있다. 그런데 오늘날 사회조건의 변화는 사람들 사이의 의사소통에 존재하던 간극을 상당부분 축소ㆍ극복할 수 있는 가능성을 높여주고 있다고 할 것이다. 물론 이러한 전망이 항상 낙관적일 수 있는 것만은 아니지만 넓은 시야로 바라볼 때 확대된 개방적이고 자유로운 커뮤니케이션의 지평과 이에 기반하여 정치 및 선거 분야에서 기대되는, 생활 속에서 펼쳐지는 자유롭고 공정한 경쟁의 장은 그 구체적인 실현을 위해 적극적으로 모색될 만한 상황과 시점에 이르지 않았나 한다. 이 글에서는 이러한 관점에서 선거현실의 부정적 측면에 효과적으로 대처하면서 선거운동의 자유를 확대하고 개방적인 경쟁환경을 조성한다는 차원에 초점을 두고 선거운동기간 전 말로 하는 선거운동 문제, 선거 당일 온라인 선거운동 문제, 의정활동 보고의 허용 문제에 대해 그 구체적인 당부를 검토한다.

According to the Constitution, the electoral system is a crucial factor in the successful operation of representative democracy and the parliamentary system, and both the freedom of election campaigns and fairness of elections have been selected as its core values. The harmonious realization of both these values simultaneously would be ideal; however, the achievement of this harmony is not always easy. A consistent regulation on election campaigns is practically considered inevitable in addressing the various negative phenomena that are expected and experienced in actual elections and securing the fairness of elections while suppressing these events. Additionally, we are unable to deny the existence of real circumstances that justify the imposition of such regulations. However, the life customs and values of people, as well as the shape of the civilization, through the development of scientific technology, have changed drastically with time. Accordingly, it seems that a foundation that permits new views and perspectives when looking at the problems in the field of elections is being prepared. Although the great significance of the guarantee of freedom in election campaigns was understood before today, it was difficult to adequately realize this significance due to concerns regarding realistic problems verified through historical experience. However, the changes in today’s social conditions have increased the chances of reducing or overcoming a considerable part of the gap that had existed in the communication between people. Of course, this outlook cannot remain positive all the time. However, from a wider range of perspectives, it is possible that we have reached the circumstances and time suitable for the realization of free and fair competitions, as expected in the fields of politics and elections based on the prospect of extended, open, and free communication. Through these perspectives, this study focuses on expanding the freedom of election campaigns and constructing an open environment for competition and carefully examines the appropriateness of the problems of holding oral election campaigns before an election campaign period, problem of online election campaigning on the day of the election, and problem of reporting parliamentary activity.
