지방자치현실을 조례의 정비의 측면에서 확인하고 그에 대한 개선방안을 모색하는 것은 본격적인 지방자치시대에 있어 필수적인 과제이다. 지방자치의 실질적내실화의 선결문제라고 볼 수 있는 지방자치단체의 조례의 질적 수준의 제고를 위 한 그 현황에 대해서 검토하여， 지방자치법 각론에 해당하는 개별 조례의 현황 및 과제에 대해서 살펴보았다. 지방자치단체는 최일선의 행정작용을 담당하여 기업과 주민에게 직접적인 영향을 미치게 되므로 국가 전체의 실질적 법치주의의 제고를 위해서는 중앙정부의 노력 뿐만 아나라， 지방자치단체의 자치법규 정비에 대한 노력이 중요하다. 최근 규 제개선의 관점에서 자치법규률 재조명하려는 움직임이 있으며， 이는 급변하는 행정환경을 반영한 규제개선에 대한 정책이 국가전체에 확산되어 시기에 어긋나지않게 집행되어야 보다 확고하게 국가경쟁력을 제고할 수 있다는 취지를 탐고 있으 며， 이 과정에서 자치법규의 규율대상과 규율방식에 대한 다양성과 자율성이 고려 되어야 한다. 지방자치제도에 대한 총괄적 관리와 법제업무에 대한 전문성이 자치입법 정비에 있어 역할을 분담하여 시너지효과를 가져올 것이며， 주무부서와의 적극적인 협력을 통해 상위법령 자체의 분권과 자치의 가능성 범주 자체를 확장할 수 있다. 지역현실을 반영하고 지역공동체률 형성하기 위한 지방자치의 내실화률 위해서는 중앙정부의 일괄적이고 통일적인 감독이 아니라， 지방자치단체의 현실적 상황에 부합하는 규제 및 제도개선이어야 할 것이다. 지방자치단체가 주민 편익 및 기 엽활동의 고충을 해결하기 위해서는 전 국민을 대상으로 한 전국획일적인 규제를 지역실정에 맞게 탄력적이고 유연하게 접근하여야 한다.
The essential task is deriving the improvement in terms of the regulations, confirming the reality of the local government ordinance. lt is the prerequisite problem of substantiality of local government and detailed exposition of the local govemment act. lt is very important issue that is the legislation apportionment system of the nation and local government. There is the recent review of government regulations in terms of regulatory improvement. This is one for the country’s competitiveness. Diversity and autonomy of the subject discipline and discipline manner of self-regulation should be considered. Collectively the management and expertise in legal work for the local government system to share the role in the maintenance municipal legislation will bring synergies. Active cooperation with individual departments can extend the scope and possibilities of decentralization of government. The regulatory and institutional improvements to meet the actual situation of the local government contributes to the substantiality of local govemment. There is a need to strengthen the system of local governments for the management system of Government Law. A uniform national regulations targeting all citizens must be resilient and flexible approach to suit local circumstances .
