Essential facilities doctrine and Investment incentives in the BcN era

정보통신기술의 발달로 우리나라는 BcN(Broadband Convergence Network)시대에 접어들고 있다. 과거 아날로그 시대에 적용되었던 필수설비원칙이 BCN시대에도 적용가능한지에 대한 검토가 필요한 시점이라고 할 수 있다. 이에 따라 이미 잘 알고 있는 내용이지만 필수설비의 정의에 대해서 다시 한번 살펴보고, 일반적으로 혼란을 겪고 있는 독점 또는 자연독점이 필수설비와 어떤 연관을 갖고 있는지에 대해서도 검토한다. 필수설비와 관련된 경제이론을 간략히 살펴본 후, 취할 수 있는 규제정책의 종류와 절차를 체계적으로 설명한다. 이를 바탕으로 KT시내망이 필수설비인지 여부와 국회에서 제기된 논의의 타당성을 검토하고 그 과정에서 영국과 미국의 사례도 제시한다. 마지막으로 차세대의 필수설비가 될 가능성이 큰 BCN망에 대한 투자동기에 대해서 검토한다.

The Korean IT industry enters into the era of the premium network or BcN(Broadband Convergence Network). Essential facilities doctrine, which was introduced in the era of old analog networks, deserves reconsideration. Regulatory tools and procedures will be explained for the essential facilities. Based upon those explanations, I will reconsider if incumbent firm’s networks are still essential facilities. Last premium network or BcN investment incentives will be analyzed when essential facilities doctrine is imposed upon such a network.
