조약의 적법성

Validity of Treaties

‘1969년 조약법에 관한 비엔나협약’이 채택된 지 36년이 지났다. 따라서 오늘날 조약 그 자체와 국가관행 및 국제판례와의 있을 수 있는 간극을 찾아 문제점을 검토할 필요가 제기된다. 이 논문은 ‘조약의 적법성’에 관한 조항들을 적용하거나 해석한 최근 사례를 검토한 연후에 혹시 관련 조항을 수정 내지 보완할 필요는 없는지 여부를 살피는 데 주안점을 두었다. 이를 위하여 필자는 관련 조항들을 실체법적 성격과 절차법적 성격을 갖는 두 부류로 나누어 검토하였다. 즉, 조약법협약 제46조 내지 제53조는 조약의 무효원인을 열거하는 실체법적 성격에 해당하며, 이는 다시 상대적 무효원인과 절대적 무효원인으로 구분하였다. 검토결과 이들 조항은 실제로 적용된 사례가 드물며, 설령 적용되었다손 치더라도 조항에 명시된 제반 요건은 상당히 엄격하게 해석되었음을 알 수 있었다. 한편 조약법협약 제65조 내지 제72조는 조약의 무효를 확정시키기 위한 절차법적 성격으로서 이를 적용한 구체적 사례가 없기에 각 관련 조항의 의미를 분명히 하는 데 아직 애로사항이 있다고 판단하였다.

Thirty-six years have passed since The Vienna Convention on the Law of Treaties was adopted. This article based on the paper presented at the Seminar entitled “the Reexamination of the Law of Treaties held on January 25th, 2004. The main purpose of this article is to examine whether any gaps exist between the Vienna Convention’s articles concerning ‘validity of treaties and the practice of states and the international jurisprudence which apply and interpret those articles. We divide the articles into two groups: those of substantial character and those of procedural character. The first group consists of Articles 46 to 53, which stipulate the causes of invalidity. The latter group consists of Articles 65 to 72, which mention the procedure to be followed with respect to the invalidity of a treaty. After careful examination, we can conclude as follows: during the 36 years following the adoption of the Vienna Convention, the practice of states and international jurisprudence have consistently supported the idea of Articles 46 to 53 concerning the causes of the invalidity of treaties and have applied the conditions of these articles quite strictly. In contrast, we can not find any international practice concerning Articles 65 to 72, so it is difficult to evaluate and clarify the meaning of those articles in international relations.
