교과 교육과정 관련 법규 개설의 한계와 개선 방향 논의 - 공교육정상화법, 인성교육진흥법, 진로교육법을 중심으로 -

교육제도 법정주의의 원칙에도 불구하고 현재 교육과정에 대한 교육법규의 규정 실태는 교육의 매우 미비한 형편이다. 이에 특별법의 제정과 시행은 진흥되고 장려 되어야 할 교육 분야에 대하여 특수화된 지원을 제공해줄 수 있다는 장점을 지닌다. 이에 본 연구에서는 교과 교육과정 관련 법규 제정의 의의와 한계를 논의하고 개선 방안을 모색하고자 최근 제정된 공교육정상화법, 인성교육진흥법, 진로교육법의 교과 교육과정 관련 규정을 분석하였다. 연구 결과, 특별법에서 제시된 교과 교육과정 관련 규정과 국가 교육과정 간에 용어 정의와 적용 범위의 불일치 및 역할 중복 등의 문제가 발견되었는데, 이는 특별법과 국가 교육과정의 교육 현장 적용에서 혼란을 야기할 수 있다는 점에서 개선이 이루어져야 할 것이다. 이에 본 연구에서는 교과 교육과정 관련 특별법과 관련하여 다음과 같은 서로 다른 두 가지 대안과 그 구체적인 사례를 제시하였다. 첫째, 특별법에서 관련 교과 교육과정의 편성·운영 및 평가에 대한 구체적인 사항을 직접 규정하기보다는 이를 장기적이고 체계적으로 연구할 수있도록 특별법의 조성법적 성격을 강화시켜야 할 것이다. 또는 둘째, 개별적인 특별 법을 제정해나가기보다는 하나의 법규 안에서 교과 교육과정 관련하여 교육현장에서 필요로 하는 규정을 충분히 제공하는 종합적인 일반법을 제정하는 방안을 모색해야 할 것이다.

This study pays attention to the special law for promotion on normalization of the public education and regulation of preceding education, the character education promotion act and the career education act which were released just before the 2015 revised national curriculum and has been implementing in the school. The aim of this study is to analyze the effect of the new educational laws in an aspect on 2015 revised national curriculum. These laws are timely and appropriate to the need of support in particular educational areas which had a lack of laws, but there is overlap between regulations on the curriculum based on the laws and those on the national curriculum. To solve the problem, this study suggest two different alternatives. To make the best decision, it is need to be studied What the roles of the educational laws and national curriculum to cope with the educational need in present and future are.
