A Study on the Organization & Characteristics of Chinese Legislative System in Agriculture Sector

This study is carried out to grasp the organization & characteristics of Chinese legislative system in agriculture sector conforming to a big social demand for comprehending that legislation system. The main results of this study are summarized as follows. (1) Law-making activities in agriculture sector is retarded relatively. Until now, only 6 kinds of laws including agricultural basic act had been enacted barely. (2) The actualization of agriculture policies is relied upon administrative legislation mainly. This study represents that the number of laws enacted in legislative organ are only 6, but the number of enacted in administrative organ are 210 in 2000. (3) It also represents that the law system shows the authority of administrative power strongly. It can be drawn straightforwardly from the fact that the punishment in considerable range is imposed by administration legislation. (4) Non-standardization of the terminology in putting laws title up shows itself as one of the characteristics in Chinese legislation system. In particular, the laws enacted in administrative organ are called many terms. (5) The effort for law-making activities related to agricultural market has come short of, on the other hand that of its activity related to agricultural production & inspection has been vigorous relatively. This fact emphasize that much concerns are focused on building a legal basis in market sector.
