Legal and Theoretical Basis of Local Diplomacy

외교란 지금까지 중앙정부의 전권사항으로 보아 국가의 외교 관련 정책은 중앙정부가 전적으로 수행해왔으나, 오늘날은 외교주체의 다원화와 외교영역의 다양화로 지방정부는 물론, 시민단체, 일반 시민에 이르기까지 외교활동의 주체로 나서고 있는 추세이므로, 외교정책과 관련한 기능의 지방이양, 지역이익의 실현을 목표로 하는 지방정부의 독자적 외교영역의 설정 등이 중요한 이슈로 등장하게 되었다. 이러한 지방외교 역시 행정의 한 유형이라 할 수 있으므로, 법률에 의한 행정 의 요청에 따라 지방정부가 수행하는 다양한 외교정책 역시 법령의 근거가 필요하다. 따라서 이 글은 지방외교정책의 정당성을 뒷받침하는 국제법 및 국내법 규정들을 검토하고, 지방외교정책을 정당화하는 지방자치에 관한 다양한 이론들에 대해서도 폭넓게 검토하였다. 즉 지방정부가 외국이나 외국의 지방정부와 수행하는 다양한 활동들은 어떠한 법적ㆍ이론적 근거 아래서 이루어지는지에 대하여 고찰한 논문이다. 유럽지방자치헌장 및 세계지방자치선언에 제시된 규정 내용이나, 미국, 프랑스, 일본 등에서 이루어지는 지방자치와 관련한 핵심적인 논의들을 살펴볼 때, 지방자치의 확대강화가 세계사적 흐름이자 앞으로의 정치행정이 나아가야 할 바람직한 방향임을 알 수 있다. 특히 이 글에서 중점적으로 논의한 것은 우리나라의 현행법상 지방외교의 국제법적ㆍ국내법적 근거보다는, 오히려 지방자치의 본지 에 초점을 맞춰 그 이론적 근거에 대한 모색과 지방자치를 둘러싼 외국의 논의 및 실제현황에 대해서 중점적으로 검토하였다. 이는 현행법상 지방외교의 법적 근거가 미흡한 탓이기도 하고, 또한 지방외교의 법ㆍ이론적 근거에 대한 학계의 적극적인 논의를 유발함으로써, 앞으로 자치권의 확대와 지방외교의 법적 근거를 법제화하는데 그 이론적 토대를 제공하기 위한 연구였음을 밝혀두고자 한다.

Globalisation is a controversial term. This is negatively equated with the decline of national sovereignty and the exploitation of vulnerable economies. At the extreme, critics often allude to global conspiracies. To others, globalisation promises a new era of enlightenment, progress and international prosperity. The reality lies somewhere between these two perspectives. Globalisation presents both threats and opportunities, it is not universally a good or a bad development. The challenge for spheres of government and at the same time defend society from its potential excesses. The role of government is certainly not diminished by globalisation, in fact, it requires more of government not less, and in all spheres. It is also applied in self-government. Korean Local Government has a strong appreciation of the value of international linkages and exchange. Sister City relationships are actively encouraged by KLAFIR(Korea Local Authorities Foundation for International Relations). Traditionally, sister city activities have revolved around the arts, culture, education, environment and social exchanges; these areas will continue to be the foundation of sister city relationships. And so, as the world changes, new areas of leadership opportunities emerges from the sister city network that many of our citizens are anxious to explore. It is a chance to take a leadership position on issue that cross international boundaries not only to take about common problems, but to suggest solutions by bringing together government, business, nonprofit organizations, and just plain folk to make a difference in the cities they call home. Many Korean cities, in partnership with their sister cities, are also organizing joint business ventures and technical projects, from historical preservation, to sustainable agriculture. Nowadays, these role of Korean Local Government expands little by little. Local Government plays a diplomacy or foreign policy. Then, is local government able to play such a role? However until now, diplomacy or foreign policy is practiced by nation. When that is admitted, what is the Legal and Theoretical Basis of Local Diplomacy? That is the aim of this thesis.
