Study on the Autonomous Right in the Organization and Personnel Management of the Local Government

Our Constitution §117 ② gives local government the right of self-organization and §118 ② oder the assembly to make it legislation, the organization and personnel management of the local government. From the above mentioned, it is possible to conclude that the organization and personnel management of the local government belongs to the power of law-regulation(nation assemble), but the specifics about them are regulated by autonomous law(power of the local assemble) within the law, paying respect to it that the sovereignty rests with the people. Giving attention to the organization and personnel management of the nation which is roughly regulated by the law and then specifically regulated by the administration - made - law, or regarding the proportional principle and the supplementary principle in Constitution, the conclusion is reasonable.
