자치경찰제 도입을 위한 법적 과제

A Study on the Autonomous Police System

자치경찰제란 지방분권의 정신에 근거하여 지방경찰이 지방자치단체의 권한과 책임하에서 당해 자치구역내의 치안업무를 담당하는 제도를 말한다. 그러나 이제까지 우리의 자치경찰제에 관한 논의를 살펴보면, 헌법이 상정하는 지방분권의 정신, 지방자치의 이념에 입각한 논의의 전개라기보다는 검ㆍ경 간의 수사권독립문제와의 상관문제로서, 또는 경찰행정의 능률성과 효율성을 제고하는 관점에서 정치권을 중심으로 논의가 진행되어져 온 것이 사실이다. 그리고 이러한 논의의 전개는 자연스럽게 경찰행정의 능률성을 증시하고 정치적 중립성을 도모하기 위해 도입되었던 일본의 공안위원회제를 근간으로 하는 절충형 자치경찰제도로 귀결하는 결과를 초래했다. 그러나 현재 일본에서도 이 공안위원회는 이미 형해화 되어버린 위원회라고하여 내ㆍ외의 비판이 제기되고 있는 실정이다. 따라서 이 공안위원회제를 우리나라에 도입하는 경우 운영에 따라서는 자치경찰의 본질을 훼손시킬 우려마저 존재하고 있다. 또한 많은 논의가 위원회제도를 근간으로 함으로써, 지방자치단체의 장과 지방의회의 역할에 대해서는 소극적인 자세를 보이고 있다. 이에 필자는 먼저, 외국의 법제도를 도입함에 있어서는 신중한 검토와 검증이 필요하다는 것, 그리고 자치경찰제를 도입하더라도 그 기본이념은 결코 경찰행정의 편의성과 능률성 등 경찰행정 그 자체를 위한 것이 아니라 국민(주민) 을 위한 제도의 도입임을 분명히 해야 할 것을 주장한다. 또한, 자치경찰제 도입에 있어서의 법적인 정비를 행함에 있어서는 경찰기본법의 재정과의 연관성상에서 논의함이 옳다는 전제하에, 자치경찰과 관련된 경찰기본법의 내용으로서, 첫째, 자치경찰의 목적과 기본이념의 명기는 반드시 법정화 할 것, 둘째, 각 경찰행정기구가 가지는 권한과 사무의 범위를 명시할 것, 셋째, 자치경찰제에 드는 비용에 관한 규정을 두어 자치경찰의 재정문제에 관한 구체적인 내용을 밝힐 것 등을 제기하고자 한다.

The autonomous police system is the system under which local police authorities under heir rights and responsibilities take charge of keeping public order within relevant districts, based on the spirit of decentralized local administrations. However. discussions made thus far on our autonomous police system did not embrace the spirit of local administrations as upheld in the Constitution or of the concept of local administrations. They instead focused on arguments over independent investigation rights between police and persecution. Likewise. actually, political circles handled the issue from the viewpoint of enhancing the efficiency and effect of police administration. Also, these discussions have naturally resulted in a compromised type of autonomous police system, based on the Japan s security committee system designed to attach importance to the efficiency of police administration and seek political neutrality. However. the security committee have become not vibrant even in Japan, raising criticism. Thus, if this security committee system is introduced to Korea. it may hurt the essence of autonomous system depending on the operation. Therefore. this writer suggests careful review and verification of the matter of introducing foreign laws and systems. Also. in reshaping relevant laws in connection with the introduction of autonomous police system. it should be discussed in linkage with the enactment of basic police laws. And. based on this presupposition, the basic police laws related to autonomous police must specify the purpose and basic philosophy of autonomous police. Likewise, they should specify the authorities and work scope of each police administrative organization. Also. they should lay down regulations regarding costs for autonomous police system, thus detailing relevant financial matters.
