Legal Examination on the Special Law of Regional Balanced Development

To embody the idea of regional balanced development prescribed in Section 2 of Art. 119 and Section 2 of Art. 120, Constitutional Law, all kinds of systems and policies have been executed by National Land Development Act, Law of Regional Balance and Promotion of Local Small and Medium Enterprises, Metropolitan Area Improvement Planning Act. But, as social, economic, cultural and educational systems and population have been centralized on metropolitan area, it has brought about unbalanced regional development, deepening of gap of national life quality, weakening of national competitiveness and development of decentralization. Therefore, Special Measures for Improving Local Economy (Bill) , Special Measures for Reviving Local Economy and Balanced Development (Bill) , Special Measures for Prevention of Concentration on Metropolitan Area and Regional Balanced Development (Bill) and Special Law for Regional Balanced Development (Bill) were proposed and presented before the National Assembly and Korean government plans to enact National Balanced Development Act in the Regular Session of National Assembly in 2003. Accordingly, this study is to examine the necessity and content of Special Law of Regional Balanced Development (Bill) and seek a desirable way of enacting this law.
