AHP를 활용한 스키장 안전사고 판결의 전문가 우선순위 분석

Priority Analysis of Judgment about Safety Accidents in the Ski Resort Using Ahp

국내의 스키장 안전사고는 매년 증가하고 있으며, 실제로 스키 활동 중에 심각한 부상이나 사망 등 중대한 사고가 일어나고, 사고 후 가해자와 피해자간에 책임에 대한 법리가 정리되지 않고 있다. 그러나 이러한 현상에도 불구하고 이에 적합한 법제 도는 제대로 이루어지지 않고 있으며, 국내의 스키장 안전사고 판결에 대한 연구는 충분하지 않은 실정이다. 이 연구에서는 스키장 안전사고 판결에 대한 전문가들의 법감정을 통하여 법리를 논함으로써, 판결의 개선 방향을 모색하고자 하였다. 이는 스키장 안전사고 연구의 새로운 시각을 제공하는 초석의 역할도 할 수 있을 것이며, 향후 스키 관계자들에게 법적지식 제공을 바탕으로 전문가로서의 위치확보에 도움을 줄 수 있을 것이다. 연구의 목적을 달성하기 위하여 스키장 안전사고 판결의 전문가 의견을 밝히기위하여 AHP 분석을 통해 우선순위를 도출하는데 있다. 이상의 과정을 통해 도출된결과는 다음과 같다. 분석 결과, 안전시설물의 설치 기준 및 스키장 하자의 정의와 유형에 대한 명확한 기준이 필요하며, 관리자의 엄격한 수준별 통제가 이루어져야 하고, 법률 적용에 있어서 고의, 과실에 따른 위법행위와 사용자책임 혹은 공작물책임 적용의 법률 선택 여부가 깊이 있게 고려되어야 하며, 획일적인 손해배상 비율에 대한 검토 및 도로교통법과는 다른 스키법을 마련해야 한다.

Domestic ski accidents had increased every year and actually, critical accidents with severe injuries or death happen, but legal principles for liability between perpetrators and victims were not confirmed. In spite of that phenomenons, proper legal and institutional systems were still poor and domestic studies on ski accidents were not enough. To achieve study purpose, discussed improvement strategies with legal expert`s cognitions by delphi method. Discussions on improvements in legal principles, legal consciousness, law and institutions for ski accident judgements made by above processes were as follows. First, legal experts` improvement strategies were necessity for definite criterion of safety structure and Mengel of resorts, managers` strict regulations by levels, careful considerations for law application like illegality, user liability and liability on structures, reexamination on uniform compensation rate, and legislation of ski law.
