WTO분쟁해결제도에 있어서 이행확보의 실태와 개선방안

The Problems and Possible Solutions of Implementation in the WTO Dispute Settlement System

WTO분쟁해결제도의 실효성을 판단하기 위해서는 회원국이 WTO협정상의 의무를 준수하기 위해 필요한 조치를 얼마나 신속하게 처리하고 있는가를 평가할 필요가 있다. 본 논문에서는 WTO분쟁해결절차에 있어서 DSB결정의 이행에 따른 문제점과 최근까지의 이행확보 현상을 분석하였다. WTO는 국가간의 통상분쟁을 효율적으로 해결하기 위해 DSU를 두고 있으며, 회원국이 협정상의 의무와 DSB의 결정에 대하여 이행의무를 합리적인 기간 내에 준수하지 않는 경우에는, 양허 및 기타 의무의 정지(대항조치)를 취하도록 하고 있다. 따라서 이러한 권고를 효율적으로 이행할 수 있도록 하기 위해서는 이행의무가 준수될 때까지 금전보상을 할 수 있도록 하거나 금전보상액이나 양허정지의 정도를 소급적으로 산정할 수 있도록 할 필요가 있다. 또한 DSB권고의 불이행이 계속되는 경우에는 그러한 금전보상액이나 양허정지의 정도를 시간의 경과에 따라 단계적으로 증액시켜 나가도록 DSU를 개선할 필요가 있다.

Purpose : To decide whether WTO dispute settlement system is effective or not, it is needed to evaluate how promptly a WTO member nation takes necessary measures to fulfill its own obligations under the WTO agreement. Research design, data, methodology : This paper uses the literature research and Case analyzes as to the problems and possible solutions of implementation in WTO dispute settlement system Results : This study aims to analyze problems found in implementing DSB rulings in WTO dispute settlement procedure and also phenomena associated with securing implementation up to now. WTO is equipped with DSU to settle disputes often arising between countries efficiently. When any member nation fails to implement agreed obligations or conform to DSB rulings within a reasonable period of time, it will be subject to the suspension of concessions or other obligations. Conclusions : Therefore, to have the countries fulfill those recommendations efficiently, it is necessary for them to make financial compensation until the obligations are fulfilled, assess the degree of financial compensation or suspension of concessions retroactively, or revise DSU so that the amount can be increased stepwise by time.
