로크의 『통치론』이 아동의 권리에 주는 함의

Review of the Issue of Children s Rights through Two Treatises of Government by Locke

본 연구의 목적은 아동학대를 비롯한 아동의 인권문제가 심각함을 인식하고, 로크의 『통치론』에 나타난 인간의 권리를 중심으로 아동의 권리에 주는 함의점을 고찰하여 교육적 시사점을 도출해 보는 것이다. 『통치론』은 로크의 정치철학이 집약적으로 담겨 있는 책이지만, 자연법에 기초한 인간의 다양한 권리를 다루고 있어 이를 통해 아동의 권리를 살펴보는 것은 의미가 있다고 본다. 이에 기초하여 아동은 생명을 존중받을 권리가 있고 자유와 평등을 누릴 권리를 가지며 부모의 보살핌을 받을 권리가 있다는 함의점을 도출할 수 있었다. 이러한 점들은 다음과 같은 교육적 시사점을 제공한다. 먼저 교육에서 생명존중 의식 함양을 위한 보다 실제적인 교육내용과 교육적 방안이 마련되어야 한다. 그리고 아동의 자기결정권을 보장하고 아동을 대상으로 한 권리존중교육의 구체적인 방안의 마련과 실제적인 활용을 가능하도록 해야 한다. 또한 자녀양육은 부모의 의무라는 점에 기초하여 지속적이고 체계적인 아동의 권리교육과 양육에 대한 부모교육을 강화시키고 육아와 관련된 사회적 지원을 강화할 수 있도록 해야 한다. 따라서 로크의 『통치론』의 고찰을 통해 아동권리의 이해를 시작으로 현 사회가 당면한 아동문제의 심각성을 인식하고 더 나아가 이를 해결하기 위한 방안 모색에 도움이 될 수 있기를 기대한다.

The purpose of this study is to acknowledge the seriousness of human rights issues of children, including the child abuse issues, and contemplate the rights of children appearing in the 『Two Treatises of Government』of Locke to formulate the implication of education. The 『Two Treatises of Government』is the book that comprehensively contains the political philosophy of Lock but it handles various rights of human based on natural law. Therefore, considerations on rights of children are sought based on the dignity of human rights that Locke emphasized. First of all, the rights of children sought through the Locke s 『Two Treatises of Government』are shown with the right to have the life to be respected, right to enjoy freedom and equality, and right to be cared by parents. Based on the foregoing points, the implications that may be applied on education are shown as follows. First of all, the right to be respected for life as emphasized by Locke shows that the dignity of life has to be advanced with respect to life and education. And, through the right to enjoy freedom and equality, children should be given the right with the freedom and equal opportunity to enjoy. In addition, the right of children deserved to be cared by parents is to think about the parenting and role of parent and ultimately connect the same to parental education. Therefore, contemplating the Locke s 『Two Treatises of Government』is expected to be acknowledge the seriousness of child issues encountered by the society by commending to understand the right of children and be of help to seek for plans to resolve the foregoing issues.
