법최면 수사의 효용성에 대한 연구

A Study of the Effectiveness of Forensic Hypnosis Investigation

법최면수사는 범죄사건을 조사하고 해결하는 데에 유용한 기법임에도 불구하고 한국에서는 형사사건에 적용사례는 많지만 실증자료를 이용한 그 효과성 분석 연구는 전무한 실정이다. 따라서 본 연구는 법최면수사를 진행한 86건의 형사사건 자료를 이용하여 법최면수사의 효용성을 검증해 보고자 한다. 특히, 텔레겐몰입척도 (TAS-K)와 한국판 하버드 감수성척도(HGSHS-K)를 이용하여 피최면자들의 감수성이 법최면 수사결과의 기억회상량과 어떠한 상관관계를 형성하는지를 살펴보 고 그 결과를 바탕으로 법최면 수사기법의 효용성에 대한 논의를 진행하였다. 분석 결과에 따르면, 텔레겐몰입척도와 법최면수사결과의 기억회상량과 유의미한 관계를 형성하지 못하는 반면 하버드감수성 척도는 최면수사 시 추가기억회상 등 긍정 적인 영향을 미치는 것으로 조사되었고 대부분의 경우 최면수사를 통해 피최면자의 기억량 회상능력이 향상한 것으로 보고되었다. 또한, 7건을 제외한 79건의 형사사건에서 최면수사가 사건해결에 기여하였거나 수사 자료로 유용하게 활용된 것으로 조사되었다.

Although forensic hypnosis investigation is a useful technique to investigate and solve criminal cases, there is virtually no empirical study to examine the effectiveness of forensic hypnotic investigation. Therefore, the primary purpose of this study is to investigate the effectiveness of forensic hypnotic investigation using 86 criminal cases in South Korea. In particular, the current study attempts to examine the empirical relationships between hypnotic susceptibility of subjects and memories in criminal cases where forensic hypnotic investigation was employed in the part of criminal investigations. Based on the 86 cases of the forensic-hypnosis investigation, this study found that the group that has a higher level of the immersion scales in Tellegen (TAS-K) and the sensitivity scales in Harvard (HGSHS-K) reported a higher level of memorial ability even though the result for TAS-K scale was not statistically significant. Overall, the major findings from the analyses implies that forensic-hypnosis investigation results had a significant impact on the increase of memorial ability of suspects. Therefore, it could be concluded that the forensic-hypnosis investigation could be a useful tool for investigating the criminal cases.
