These revisions were done to reflect current changes in international customs and to avoid or reduce the uncertainties caused by different interpretation of a particular trade terms. The latest major change in the Incoterms rules is the separation of the place-to-place delivery terms as multimodal from the delivery that are simply port-to-port as maritime terms. Nonetheless, up to now many Incoterms rules including FOB, CFR, CIF (traditional terms) rather than multimodal terms (FCA, CPT, CIP), continues to be misused and misunderstood by international trading partners. The misuse of trade terms is a legal matter as well. If traders continue to misuse Incoterms rules in their international shipping contracts and carriage, they can not be in control over the goods thus, creating a risk gap. In this case, traders must be willing then to assume the risks of loss or damage until loaded onboard. Using the right terms may prevent disputes and provide clarity in their trading relationships. herefore, through questionnaire surveys of 144 respondents the purpose of this study is to analyze the usage and problems of Incoterms rules interpretation in small and medium international trading companies and verify the reason why traders select incorrect trade terms.
