한국 헌법상 정보통신기반에 대한 국가책임의 실현에 관한 고찰

A Study on the Realization of Constitutional State Responsibility for Information and Telecommunications Infrastructure in Korea

사실적인 면과 규범적인 면을 모두 고려하는 관점에서 국가가 어떤 활동을 해야 하는지를 모색하는 미래지향적인 요소가 있는 책임 개념을 헌법적 차원에서 정립하는 것은 현존하는 규범의 해석에 따른 책임뿐만 아니라 국가의 새로운 책임을 규범적으로 창설하는 방법을 도출하는데 유용하다. 그에 따라 현행 규범에서 충분히 다루지 못하는 새로운 사회변동에 대한국가의 구체적인 규범적 대응을 체계적으로 밝힐 수 있다. 정보사회의 발전은 현재 진행 중이면서 향후에도 지속적으로 확대될 가능성이 높은 현실의 문제로서, 새로운 사회변동에 대응하는 미래지향적 요소를 지니는 국가의 책임에 부합하는 사안이다. 헌법적 차원에서 정보사회와 관련되는 국가의 책임을 모색함에 있어서는 정보사회의 기초가 되는 정보하부구조로서 정보통신기반이 일차적인 고찰 대상이 되어야 한다. 사회변동 대응과 공공성 확보라는 현실적 필요성에 따라 정보통신기반의 구축과 보호에 대한 국가의 역할이 요구되고 있으며, 헌법상 국가책임의 구성요소와 정보통신기반은 본질적으로 밀접한 관계가 있다. 그러나 현행 헌법규정에 의하면 헌법상 정보통신기반에 대한 국가책임의 실현을 관철할 수 있는 범위가 제한적이기 때문에 정보통신기반 관련 헌법규정의 신설이 요구된다. 헌법상 정보통신기반에 대한 국가책임의 규범력 확보는 정보질서의 정립에서 중요한 기능을 할 수 있을 것이며, 궁극적으로 정보사회의 기초를 완성하게 될 것으로 기대된다.

Establishing the concept of constitutional responsibility, which has a futuristic element that seeks to figure out what the state should take in view of both factual and normative aspects, is useful to derive a method for not only check on the responsibilities in existing norms but also creating new normative responsibilities. Accordingly, it is possible to systematically clarify the specific normative responses of the state to new social changes that can not be adequately covered by the current law. The development of the information society is a matter of reality that is ongoing and is likely to continue to expand in the future. And it meets the state responsibility with future-oriented elements to cope with new social changes. In constructing the state responsibility related to the information society, the information and telecommunications infrastructure as the basis of the information society should be a matter of primary consideration. The role of state for construction and protection of the information and telecommunications infrastructure is required with the necessity of response to social change and preservation of publicness in practice. The elements of the constitutional state responsibility are intrinsically closely related to information and telecommunications infrastructure. However, realization of constitutional state responsibility is limited by current Korean Constitution. So constitutional revision is needed to codify new norm of information and telecommunications infrastructure. Securing the normative power with constitutional state responsibility for the information and telecommunications infrastructure will play an important role in establishing the information order, and ultimately it will be expected to complete the foundation of the information society.
