통풍권의 법리에 관한 연구

우리나라는 국토가 협소하고 3면이 바다로 둘려 쌓여 있고, 기후온난화 경향으로 아열대기 후화로 변화되고 가고 있다. 특히 통풍은 여름철의 집중호우와 고온다습한 기온에 의해 습도등 쾌적한 생활환경에 중요한 영향을 끼치고 있다. 쾌적한 통풍환경은 여름철의 고온다습한 집중호우기간에는 그 어느 때보다 중요시 되고 있다. 통풍권 침해에 관한 환경분쟁은 경제성장과 도시의 발달, 인구증가로 도시의 건축물의 건축 밀도가 높아지고 고층건물, 수직증축화로 인하여 일조권, 조망권, 환경상 프라이버시권 침해와 더불어 증가되어 가고 있다. 그러나 환경권의 하나의 권리로 인정할 수 있는 통풍권에 관한 법리에 관한 연구는 거의 이루어지지 않고 있을 뿐만 아니라 통풍권의 관계 법령에서 통풍권의 개념이나 법적보호요건 등을 명시하지 않고 있다. 통풍권의 법리연구는 쾌적한 통풍환경을 객관적 가치로 보호하기 하기 위하여 절실히 필요하다고 할 것이다. 따라서 주거지역에서의 통풍권의 개념과 법적근거, 통풍권의 법적성질을 검토한 후, 독자적 권리성 인정여부와 통풍권의 보호요건에 관한 법리를 강구하여 통풍권침해 또는 방해로 인한 환경 분쟁을 최소화하고 신속한 권리구제를 받을 수 있도록 하고자 한다.
