이원적 경찰제도를 통한 자치경찰의 구현방안:

A Study on the Implementation of Local Police System through the Dualistic Police System: Focused on the Analysis of the Fire Structure System

대한민국은 그동안 법조 인력들의 전유물처럼 여겨졌던 기소절차와 형사재판에까지 시민들이 직접 참여함으로써 형사사법절차의 민주성을 확보해 나가고 있다. 그러나 경찰조직은 국가경찰체제를 채택해 집권성, 능률성, 책임성, 합법성이라는 요소들은 담보할 수 있지만, 민주성이라는 요소를 담보하기에는 어려움이 따른다고 할 수 있다. 따라서 현재의 소방조직이 갖추고 있는 중앙의 국가소방체제와 지방의 광역화를 통한 지방소방체제라는 이원적 조직체계를 참고할 필요성이 있다. 국가경찰체제와 자치경찰체제는 각 제도의 장점이 단점이 되고, 그 단점이 장점이 되는 특징을 가지고 있기 때문에, 두 제도 중 한 제도를 선택적으로 채택하기 보다는 두 제도의 장ㆍ단점을 보완할 수 있도록 두 제도를 조화시킬 필요성이 있다. 현대의 민주국가에서는 민주성을 담보하기 위한 다양한 제도들이 도입되고 또 적용되고 있다. 그러므로 범죄예방, 발생한 범죄에 대한 대처, 대민봉사 등의 다양한 업무를 수행하고 있는 경찰조직에서도 시민참여를 통한 민주성확보 방안들이 제시되어야 한다. 이는 조직적 민주주의를 형성하기 위한 방안에 국한되는 것이 아니라 조직외부의 민주성까지 담보할 수 있는 방안이 될 수 있기 때문이다.

South Korea has got better ensured democracy of the criminal justice process by directly participating of people to prosecution process as well as criminal trials that are recognized as possessions of legal professions for a long time. However police organization can afford to ensure power concentration, efficiency, accountability and legitimacy by adopting the state police system, but it is hard fir police organization to ensure democracy. Thus, fire-fighting organization is needed to be a reference to the dualistic organizational system through the state fire protection system and local fire protection system. Because the state police system and local police system are related to one’s advantages as the other’s disadvantages and vice versa, these two systems are needly combined in order to take each advantages rather than selectively take a system. Modern democratic nations have adopted and applied a variety of system to secure democracy. Therefore, the ways of securing democracy should be shown through civil participation in police organization that performs diverse tasks such as crime prevention, crime response, public service. These can be good measures to ensure not only internal democracy but also external democracy of police organization.
