This study investigated that ‘why is the Trademark Law protect the interests of consumers?’ It is originated with the character of the trademark as intellectual property that why is the trademark law protect the interests of consumers. Article 1 of the Trademark Law stipulates that “the purpose of this Act is to contribute to the development of industry and to protect the interests of consumers by pursuing to maintain, through the protection of trademarks, the goodwill of those using trademarks.” To protect the interests of consumers is the Trademark Law’s peculiar character which separate Trademark Law from Patent Law and Design Law. The profits generated by the trademark is essential to contribute to the development of industry by the trademark. And to generate profits by the trademark is accomplished by the process of the interests of consumers that is to select the product by means of the trademark. For the reason above, article 1 of the Trademark Law stipulates that “the purpose of this Act is … to protect the interests of consumers.”
