오픈소스 라이선스의 양립성(Compatibility)에 관한 연구 - GPL과 다른 오픈소스 라이선스간의 충돌과그 해결방안을 중심으로 -

The Research on the Compatibility of Open Source Licenses

소프트웨어 라이선스의 양립성에 관한 문제는 복수의 소프트웨어 코드를 결합하여 새로운 프로그램을 만들고자 할 때 각각의 코드에 적용된 라이선스가 상호 양립불가능한 조건을 포함 하고 있을 때 발생하게 된다. 독점 소프트웨어 라이선스들은 매우 엄격한 라이선스 조건들을 포함하고 있기 때문에 대부분 상호 양립불가능하지만, 오픈소스 소프트웨어의 라이선스 조건들은 매우 완화되어 있으므로 양립성 문제가 중요한 쟁점이 되고 있다. 독점 소프트웨어 라이선스와 오픈소스 라이선스의 양립성 문제는 비교적 오래된 쟁점으로서 특히 기업 실무자들 사이에서 어떤 종류의 오픈소스 소프트웨어를 자사의 상용 소프트웨어에 포함시킬 수 있는가의 문제, 그리고 그 과정에서 지켜야 하는 ‘컴플라이언스’에 관한 쟁점들을 논의해 왔다. 하지만 오픈소스 라이선스들 사이의 양립성에 관한 문제는 국내에서는 아직까지 충분히 검토되고 있지 못하다. 오픈소스 라이선스들 사이의 양립성 문제의 중심에는 GPL이 있는데, 그 이유는 GPL이 강력한 카피레프트 조항과 함께 추가적인 제한사항을 금지하고 있기 때문이다. GPL은 카피레프트 라이선스들과의 관계에서뿐만 아니라 非카피레프트 라이선스와의 관계에서도 양립불가능한 경우가 많아서 오픈소스 커뮤니티에서 다양한 문제가 발생하고 있다. 오픈소스 라이선스의 양립성 문제를 해결하기 위하여 한편으로는 라이선스의 내용에 관련 내용을 포함시키거나, 다른 한편으로는 오픈소스 커뮤니티의 라이선스 정책을 유연하게 하는 등의 다양한 해결방안이 제시되어 왔지만 현재까지도 풀지 못한 쟁점들이 다수 남아 있는 상황이다. 오픈소스 소프트웨어를 활용하여 비즈니스를 수행하고 있는 기업들은 오픈소스 라이선스의 양립성과 관련된 리스크를 분석하고 적절히 대비할 필요가 있다.

The issue of software license compatibility arise when it comes to combining a software code with other one applied different licenses which contain contradictory requirements. Most proprietary software licenses are incompatible with each other because they contain very strict licensing terms. On the other hand, licensing conditions for open source software are relatively simple compared to proprietary software license, so compatibility issues of open source licenses are common. Compatibility issue between proprietary and open source licenses is a relatively old one and has been discussed for a long time as ‘license compliance’issues among business executives in Korea. However the issue of compatibility among open source licenses has not been fully examined in Korea. At the heart of compatibility issue among open source licenses lies the GPL which contains strong copyleft clause and prohibits further restriction. GPL can be incompatible with permissive licenses as well as copyleft licenses, so there are various problems in open source community. Although various solutions have been proposed to solve the compatibility problem of open source licenses, such as revising licenses on the one hand and flexible licensing policies of open source communities on the other, there are still many issues that have not been solved to date. Companies using open source software in business need to analyze and adequately address the risks associated with compatibility of open source licenses.
