Vitalizing the Right to Make Derivative Works

저작자의 동일성유지권은 저작자와 일체가 되는 가장 중요한 권리의 하나로서 온전한 보호가 매우 중요하지만 동일성유지권을 완벽하게 보호하는 경우, 2차적저작물작성권은 사실상 그권리의 존재 의미를 상실할 수도 있어 보인다. 2차적저작물작성권은 원저작물을 바탕으로 또 다른 저작물을 창작할 수 있도록 함으로써, 원저작물의 창작과 함께 문화 및 창작의 환경을 활성화하는 중요한 역할을 한다. 또한 2차적저 작물은 먼저 창작된 원저작물의 감동과 이해에 영향을 미쳐 원저작물의 저작물성 또는 예술적 가치나 원저작물 저작자의 인격권에도 영향을 줄 수 있으며, 기존의 원저작물의 가치를 다시 새롭게 탄생시키는 견인차의 역할을 하기도 한다. 따라서 2차적저작물의 활성화는 창작 및 문화 환경의 활성화와 함께 원저작물 저작자에게도 궁극적으로 긍정적인 영향을 줄 것으로 보인다. 즉 동일성유지권과 2차적저작물작성권은 불가분의 관계에 있고 동일성유지권은 저작인격권의 성격과 함께 저작재산권의 성격도 함께 가지는 것으로 보인다. 그러므로 원저작물 저작자가 타인에게 2차적저작물작성권을 인정한 경우에는 그 타인에 대해서 더 이상 원저작물 저작자의 동일성유지권의 침해 여부가 문제되지 않도록 하여 동일성유 지권과 2차적저작물작성권의 불가피한 균형의 문제를 조정할 수 있는 절충안이 필요해 보인다.

The right to integrity, in communion with a creator, is one of the most important rights regarding copyright and needs to be integrally protected. However, the excessive focus on the right to integrity would deprive the reason for existence of the right to make derivative works. The right to make derivative works lets derivative works created on the basis of original works, and, therefore, plays a critical role in revitalizing cultural creation. The right to make derivative works could foster an appreciation of original works and influence the artistic values of original works and moral rights of original creators, and can endow existing works with new values. Thus, the revitalization of derivative works can promote a cultural environment and positively influence creators of original works. That is, the right to integrity and the right to produce derivative works are interconnected in an inseparable way, and the right to integrity seems to have the characteristics of an economic right as well as a moral right. Therefore, in order to foster a cultural environment, encouraging creation of derivative works, the right to integrity would be claimed only before the right to produce derivative works is not permitted and should not be claimed against the permitted thirty who is permitted to obtain the right to produce derivative works.
