오래된 저작권 풍경과 킨들(Kindle) 이 펼쳐 놓은 e-Book

온라인 네트워크 환경에서 종래의 종이책을 갈음하고 있는 e-Book은 형식의 탈바꿈이 본질적 요소에까지 영향을 미치고 있다. 종래 종이책을 이용할 때 적정하였던 규정과 이의 해석론이 이제는 그 한계에 다다르게 되었다. 변화하는 것에만 매달리면 혼란을 피할 수 없고 변화를 수용하지 않으면 앞으로 나아가지 못한다. e-Book에 관한 저작권법의 규정과 해석론은 종이책의 그 것에 머물러 있지 말아야 한다. 이런 논의와 연계하여 국내 e-Book에 관한 논의는실체적으로 콘텐츠 확보하는 일에 초점이 맞추어져야 한다. 선택할 수 있는 다양한 대상이 소비자(이용자)에게 소개되고 소비자가 관심을 쏟을 때 활성화를 이룰 수 있다. 이 글은 미국에서 킨들이 펼쳐 놓은 e-Book과 그 서비스를 논의 실마리로 삼아 국내에서 전개되는 e-Book 관련서비스와 이의 발전에 필요한 법적 논의를 살펴보고자 하는 데에 연구목적이 있다. 현행 저작권법 및 도서관법 등의 규범체계는 종이책 이용에 머물러 있다. 이를 위하여 킨들로 불붙은 e-B k에 관한 실체를 우선 파악한 후, e-Book 리더기에 내려받은 콘텐츠에 대한 저작권법상 최초판매원칙 적용 여부 및 e-Book과 관련한 현행 저작권법 및 관련 법률의 규정을 살펴본다. 또한, e-Book과 전자도서관 이용이라는 새로운 환경에서 모색하여야 할 규범체계를 살펴본다.

The Amazon s Kindle has opened doors for the electronic bookfhereinafter ‘e-Book’ ) which referred to the concept on Project Gutenberg o f 1971. The Kindle is one o f specifically designed devices for the purpose of reading electronic texts. This newly emerging reading device lets the digital contents downloaded via 3G or Wi-Fi for the wireless networks. Although the e-Book is comprised of the wireless reading device and the digital contents, the digital contents are the core part o f the e-Book provided with various forms, genre, and reading matters. An e-Book is so much different from a conventional paper book in that people who download the contents for e-Books have a digitally licensed status, while people who have physical books hold its ownership. People having e-Books get uncomfortable with applying the first sale doctrine, the right o f distribution and the sales contract theory depending on the conventional copyright. The diffusion of the reading device makes the legal perspectives on the e-Book scrutinized. This article examines the comparison between copyright issues o f paper books and those of e-Books, and suggests the legal explication for facilitation of e-Books and digital libraries in the near future.
