한․ 미 FTA 저작권 분야 협상결과 및 국내법 이행 검토

본 글은 2가지 물음에서 출발하였다. 하나는 저작권(집행 제외)과 관련하여 한․ 미 FTA에 포함된 새로운 의무사항, 소위 TRIPS-plus 규정들이 무엇인지이다. 다른 하나는 한․ 미 FTA 이행을 위해 국회에 제출된 저작권법 개정안이 상기 저작권 관련 한․미 FTA상 의무를 이행하기에 충분한지이다. 이러한 취지하에, 본 글은 한․ 미 FTA상 저작권 관련조항들 각각의 법적 의미와 국내법 이행에 대해 분석하였고, 다음과 같은 결론에 도달하였다. 첫째, 한․미 FTA상 저작권 분야(집행 제외) TRIPS-plus 규정으로는 제18.1조 3항의 국제협약 가입의무, 제18.4조 1항의 일시적 복제 인정,제18.4조 2항의 배포권 인정, 제18.4조 4항의 저작권 보호기간 연장, 제18.4조 7항의 기술적 보호조치 보호, 제18.4조8항의 권리관리정보 보호, 제18.4조 9항의 중앙정부기관 정품사용의무, 제18.5조의 저작자에 대한 공중전달권, 제18.6조 2항의 생실연에 대한 공중전달권, 제18.6조 3항의 실연․음반에 대한 방송권․공중전달권, 제18.7조의 암호화된 방송신호의 보호 등이 해당된다. 중요한 점은 상기 TRIPS-plus 규정들은 저작권 보호를 강화하면서도 그로 인한 부작용을 최소화할 수 있도록 안전장치도 함께 포함하고 있다는 것이다. TRIPS-plus 규정이기 때문에 무조건 우리 경제에 부담이 되는 것은 아니다. 긍정적 측면과 부정적 측면을 모두 가지고 있으며, 국내 이행과정에서 새롭게 도입되는제도를 얼마나 잘 이해하고 활용해 나가는지가 중요하다. 둘째, 한․ 미 FTA 이행과 관련, 현재 국회에 계류 중인 저작권법 개정안이 한․ 미 FTA상 의무를 전반적으로 충실히 반영하고 있는 것으로 평가하였다. 다만, 제18.6조 2항 및 3항에 규정된 실연․음반에 대한 ‘공중전달권’ 등 일부 사항에 대해서는 정책적 차원에서 이를 보다 명확히 하는 방안이 검토될 필요가 있는 것으로 보인다.

This study purposes to analyze two outstanding issues relating to copyright protection (excluding copyright enforcement) of the Korea-U.S. Free Trade Agreement (“KORUS FTA”). One is to identify TRIPS-plus provisions in the KORUS FTA which impose new obligations. Supporters argue that TRIPS-plus provisions will benefit our economy, while opponents claim that those provisions will benefit only U.S. companies. It is hard for us to tell which side is right or wrong; however, we had better take a positive stance for making the best use of KORUS FTA. In this regard, TRIPS-plus provisions in the KORUS FTA should be reviewed throughly. The other is whether the Amendment of Copyright Act (“Amendment”) fully implements all obligations of the KORUS FTA. Once the agreement gets ratified, a bilateral consultation for FTA implementation will begin. As we could see in the case of U.S.-Peru FTA and U.S.-Oman FTA, intellectual property rights sector including copyright will become one of the most complex and difficult issues during the consultation. Advance preparation is required. Against this backdrop, the study focuses on legal interpretation and domestic implementation for each provisions of Article 18.1, Article 18.4, Article 18.5, Article 18.6, and Article 18.7. In sum, TRIPS-plus provisions of the KORUS FTA include Article 18.1 para.3 (accession to international IPR agreements), Article 18.4 para.1 (right of temporary reproduction), Article 18.4 para.2 (right of distribution), Article 18.4 para.4 (70-year protection period), Article 18.4 para.7 (protecting effective technical measures), Article 18.4 para.8 (protecting right management information), Article 18.4 para.9 (not using infringing computer software in central government), Article 18.5 (author’s right of communication to the public), Article 18.6 para.2 (performer’s right of communication to the public relating to unfixed performance), Article 18.6 para.3 (right of performers and producers of phonogram to prohibit the broadcasting and any communication to the public), and Article 18.7 (protection of encrypted program-carrying satellite and cable signals). TRIPS-plus provisions is not a matter of good or bad. What is important is to wisely implement FTA obligations with properly taking into account textual flexibilities. With respect to FTA implementation issues, the current Amendment of Copyright Act successfully reflects TRIPS-plus provisions of the KORUS FTA. Meanwhile, it seems that further careful reviews are required for a couple of issues where the interpretation is not clear by its apparence, including the right of broadcasting and communication to the public relating to Article 18.6 para.2 and para.3.
