우리나라의 저작권 세관신고제도 도입에 대한 고찰

오늘날 지재권에 대한 높은 관심과 더불어 문화산업의 발전에 따라 저작권의 중요성이 점차 증대되고 있다. 이와동시에 효율적이고 실질적인 저작권 보호를 위하여 집행수준 및 감독강화에 대한 요구도 높아지고 있는 게 현실이다. 우리나라 역시 한-미 FTA를 통해 전반적인 지재권 집행의 수준이 크게 강화되었고, 저작권에 있어서도 기존에 없던세관신고제도를 도입하게 되었다. 이는 미국의 제도로서 저작권 침해 물품을 국경 단계에서 차단함으로써 저작권 침해로 인한 막대하고 급속한 피해의 확산을 방지하기 위한 목적으로 운영되고 있다. 미국은 Code of Federal Regulation, Part. 19 Subpart D에서 저작권의 세관신고에 관해 규정하고 있다. 저작권 침해 물품의 수입에 대하여 효율적인 보호를 받고자 하는 저작권자는 미국 저작권청에 우선 해당 저작권을등록하고 세관에 신고하여야 하는데, 세관에 신고된 저작권은 20년 동안 세관의 보호를 받게 된다. 세관신고에 대한보호기간 이후에도 저작권의 보호기간이 존속한다면 세관신고의 갱신을 통해서 재차 보호받을 수 있고 각각의 단계에서 일정한 비용이 요구된다. 미국 세관은 점차 증가하는 저작권 침해의 현실에서 저작권을 보다 더 강력히 보호하기위해 세관의 역할을 증대할 필요성에 대해 언급한 바 있으며, 이에 따라 관련 규정의 개정을 제안한 바 있다. 우리나라에 도입된 세관신고제도 역시 상당 부분 미국의 규정과 매우 유사하기 때문에 미국의 제도와 규정 및 개정 논의를 검토한다면 향후 우리나라 세관신고제도의 효율적 운용에 기여할 수 있을 것으로 기대한다.

Today, with growing concerns over intellectual property rights and thriving culture industry, it is increasingly important to protect effective and adequate protection of intellectual property rights and to strengthen measures and procedures to enforce intellectual property rights. After concluding the KORUS FTA, the Korean government heightened measures and procedures to enforce intellectual property rights and adopted a new system “Recordation of Copyrights” for more effective protection of intellectual property. The system, created by the United States, is designed to prevent the entry into the channels of commerce in the jurisdiction of imported pirated copyright goods through border measures so as to avoid the proliferation of considerable harm to the right holder. “Recordation of Copyrights” is stipulated in the U.S. Code of Federal Regulation, Part. 19 Subpart D. To secure Customs protection against the importation of infringing copyright goods, the copyright owner shall file an application to record a copyright in writing addressed to the Intellectual Property Rights Branch, U.S. Customs Service. The recordation of copyright shall remain in effect for 20 years unless the copyright ownership of the recordant expires before that time. If a recorded copyright has a term which exceeds the original 20-year recordation, continued Customs protection may be obtained by renewing the recordation. Each procedure shall require payment of a fee to the U.S. Customs and Border Protection(CBP). Under the circumstances where the number of cases of copyright infringement increases, the U.S. CBP has recently proposed the amended regulation to strengthen enforcement and procedures and stressed the necessity of a greater role of the U.S. CBP. As Korea’s newly adopted system “Recordation of Copyrights” is quite similar to the U.S. Recordation system, it is expected that a closer examination on the related U.S. regulations and discussions about their amendment will contribute to the effective enforcement of Korea’s newly adopted “Copyright Recordation.”
