한 • EU FTA 협상의 저작권 논의에 관한 소고

우리나라는 한미 FTA를 체결한데 이어 리와의 FTA 협상을 진행하고 있다. 미국과 EU는 공히 가장 높은 수준의 지적재산권 보호를 행하고 있는 선진 경제권으로서 이들 국가와 FTA를 체결하는 것은 국내적인 지적재산권 보호체계에 대한 상당한 변화를 가져올 수 있는 가능성을 내포한다고 할 수 있다. 미국과 리 는 지적재산권 체계 및 보호수준에 있어 유사한 점도 많지만 차이점도 상당 부분 존재한다. 이러한 차이점이 협상과정에서 어떻게 논의되는지 또한 한미 FTA plus로 규정되는 분야가 많은 지에 따라 한 미 FTA는 국내지적재산권 보호체계에 또 다른 변화를 가져올 수 있는 협상이라고 하겠다. 이에 본고는 한_EU FTA 협상에서 저작권 분야에서 쟁점이 되었던 사항에 관하여 검토하고 특히 한미 FTA와 비교하여 고찰함으로써 한EU FTA가 국내 저작권 체계에 가져다 줄 시사점을 도출하는 것을 목적으로 하고 있다. 한- EU FTA 협상에서 저작권 분야의 경우, 리 의 역내지침과 우리의 저작권법 및 미국과 제도적인 차이가 있는 분야 중 특히 공연보상청구권과 추급권이 가장 큰 쟁점이 되었다. 또한, 협상에서 이슈화하지는 않았지만 사적 복제 보상금제도도 EU와 차이가 있는 제도임이 인식되었다. 한편, 저작권 보호기간과 관련해서는 우리나라가 한미 FTA를통하여 보호수준을 큰 폭으로 상향조정한 바 있기 때문에 상대적으로 큰 쟁점이 되지 않았다고 할 수 있다.

After signing the K아 ea-US(KORUS) FTA, Korea has been negotiating the Korea-EU FTA. Negotiating FTAs with the U.S. and the EU, both o f which provide a high level of protection for intellectual property rights, could have significant implications for the domestic system of intellectual property protection. There are some differences as well as similarities in the systems o f intellectual property protection in the U.S. and in the EU. Depending on how these differences are played out in the negotiations and also to what extent the Korea-EU FTA will include KORUS-plus elements, the Korea-EU FTA could result in a change in Korea’s intellectual property protection system. This study aims to analyze the main issues raised in the area of copyright and related rights in the Korea-EU FTA negotiation. In particular, it compares these issues with the relevant clauses contained in the KORUS FTA. The remuneration paid by the user when a phonogram is used for communication to the public and the artists resale right have been most contentious issues during the negotiations in the area o f copyright. In addition, many EU countries were found to have introduced a system o f the remuneration for private copying, although the issue was not formally raised in the negotiations. On the other hand, the term o f copyright protection has not become a major issue in the Korea-EU FTA as Korea already raised the term of protection significantly through the KORUS FTA.
