공정이용법리 측면에서 본 클라우드 전자책 서비스에 대한 고찰

컴퓨터와 현실세계가 한층 밀접해지면서 오프라인의 다양한 콘텐츠들이 온라 인으로 접근할 수 있는 방식으로 변화하고 있다. 책도 마찬가지다. 스마트폰과 태블릿 PC 등 휴대용 기기가 보편화되고, A m azon . com , A pple , Google 등 다양한 사이트들이 저렴한 가격으로 전자책 콘텐츠를 제공하며 전 세계적으로 전자책 시장이 급성장하고 있다. 최근 전자책 시장에 뛰어든 Google은. 폐쇄적 유통 시스템인 iBook S to re를 채택한 A pple과 달리, A ndroid 또는 iP a d /iP h o n e 에 Google Play Book 응용프로그램을 무료로 설치하여 자유롭게 이용할 수 있도록 전자책 유통 사업자들에게 개방된 유통시스템을 구축하였다. 또한 선두를 달리는 디지털 교과서 업체인 Inkling은 최근에 누구나 손쉽게 전자도서를 제작할수 있는 클라우드 기반 무료 협업 디지털 출판 플랫폼인 ‘In kling H abit ’ 을 출시 하여 주목받고 있다. 이렇듯 클라우드 기반의 전자책 서비스가 활성화 되고 있다. 이는 다양한 콘텐츠들이 수많은 제작자들에 의해 종합적으로 구성되고 여러 기기에 서비스되는 형태이다. 따라서 지금까지의 컴퓨터 기술에서는 예상치 못했던 다양한 저작권적 문제 발생이 예측 되고 있다. 공정이용이란 저작권자에게 허가를 구하지 않고도 제한적으로 저작물 이용을 허용하는 미국 저작권법상의 규정이며 한 미 FTA 체결을 통해 우리나라 저작 권법에 도입되었다. 그러나 미국은 판례법 중심이라는 점, 공정이용 판단 기준이 일관되지 않는다는 점에서 새로 도입된 우리나라의 공정이용법은 다양한 방향으로의 법 적용 가능성. 독자적인 판단 기준을 새울 수 있는 가능성을 내포하고 있다. 이에 본고는 클라우드 컴퓨팅 시스템을 통하여 전자책이 서비스 될 경우에 발생할 수 있는 저작권적 문제인 일시적 ■ 사적 복제. 타인의 저작물 이용 문제, 권리보호, 이용허락 획득 문제를 논하고. 다양한 법적용의 가능성을 가진 공정 이용법리를 적용하여 대처 방안을 도출시킴으로써 앞으로 발생할 수 있는 클라 우드 컴퓨팅 전자책 서비스의 저작권 분쟁 예방에 도움이 되고자 한다.

A variety of offline contents is changing into a way to access their own online through the close relation between computers and the real world. Book is the same. Portable devices such as smart phones and tablet PC are becoming more common, because Amazon.com, Apple, Google and various sites in the e-book content are available at affordable prices and worldwide e-book market is growing rapidly. Recently, Google which jumped into the e-book market, constructed the open distribution system that is freely available to the e-book distributors unlike Apple sticking to the closed system. In addition Inkling, a leading supplier of digital textbook company, recently released Inkling Habit which helps anyone to make their own e-books, based on a free collaborative digital publishing platform. Thus the cloud-based e-book service is promoted. Owing to these newly emerging service forms, it is expected that various copyright problems may occur. Fair use means the limited use without previous permission from the copyright holder in U.S., it was introduced to Korean Copyright law’ through FT A between both countries. However, the application of the rule in Korea has not been determined strictly yet and then it is possible that we apply the rule unlike USA, establish our own standard. Thus this paper aims to draw a conclusion to apply Fair use doctrine to copyright disputes of cloud computing e-book service through the discussion of the temporary copy, private copy, the use of other s ownership, rights protection, license acquisition.
