빅데이터 활성화와 저작권 문제- 하둡{Hadoop)을 중심으로 -

정보통신기술 발전으로 기존의 데이터베이스로는 처리하기에 너무 많은 시간과 비용이 소모되어 활용할 수 없었던 대용량 데이터를 처리함으로써 새로운 비즈니스 가치를 창출하고 이를 통해 성공한 사례가 발생하면서 빅데이터는 IT 분야에 최대 이슈로 급부상하였다. 이러한 대용량의 데이터를 ‘빅데이터( Bigdata )’ 라고 하며 현재 빅데이터를 처리하는데 있어서 하둡( Hadoop )이 사실상의 표준으로 자리잡고 있다. 이 논문에서는 빅데이터와 관련된 저작권 문제에 대해 알아보기 위해 데이터 베이스에 대한 기본적인 개념 뿐만 아니라 빅데이터 플랫폼인 하들에 대한 개념과 실제 빅데이터의 처리과정을 기술적으로 설명하였다. 그리고 이러한 기술적 이해를 바탕으로 빅데이터의 처리과정, 즉 데이터 소스단계, 수집단계, 저장단 계, 분석단계 등 각 단계별로 발생할 수 있는 저작권 문제와 데이터베이스 제작자 보호, 오픈소스 라이선스 등의 문제를 살펴보았다. 마지막으로 빅데이터가 가지는 산업적인 측면뿐만 아니라 공익적인 측면에서 이를 활성화있는 방안으로 기존 저작권법 체계 내에서의 활성화 방안，“클라우 드컴퓨팅 발전 및 이용자 보호에 관한 법률”에 의한 활성화 방안, 별도의 입법을 통한 활성화 방안을 제시하였다.

In the past, IT companies were not able to process massive data because it just took too much time and expenses. However, as information technology became growing and developed, they began to process the massive data, leading to the creation of value. During the course of its development, the success stories have become the model to follow and the hottest issue in the IT field. Such massive data is also known as ‘Big Data’ and ‘Hadoop’， which is the framework to process massive data, is becoming the de facto standard. To look deeper into the copyright issues and problems associated with Big Data, this paper technically describes not only the basic concept of database, but also the concept of ‘Hadoop’ as well as its processing procedure. In conjunction with the technical understanding of Hadoop, this paper analyzes the copyright issues that could occur in each step of processing data-data source, collection, storage, analysis, and etc.-along with the protection of database producers and open source licenses. Finally, this paper suggests a proposal in which Big Data can be utilized not only in industrial aspects, but also in the aspect of public interests through the invigoration of big data analysis within the framework of existing copyright law systems. It also proposes the methods of invigorating through legislating new law called “Cloud Computing development and Consumer Protection Act” or other new legislations.
