이른바 ‘곡비’ 지급에 따른 음악저작물의 이용허락계약과 신탁계약 효력 :

여기에서 살펴보는 사건판결(대법원 2006. 12. 22. 선고 2006다21002 판결)은 음악저작자가 신탁계약을 체결한후 자신의 저작물에 관한 일체의 권리를 수탁자에게 맡긴 후, 이와는 별도로 저작자음반제작자 사이에 저작물의 이용허락계약을 체결하여 곡비를 계약상대방으로부터 수령한 경우에 이 양자의 법률관계를 살펴보는 데에 논의의 초점이맞추어져 있다. 저작권법 저P8조에 기하여 설립되어 저작권신탁관리업을 행하는 원고는 저작자와 체결한 신탁계약이선행하므로 저작자의 저작권이 수탁자인 원고에게 속하게 되므로 이에 반하는 저작자음반제작자 사이의 법률관계를허용할 수 없다는 것이 법리에 합치한다고 보았다. 이에 반하여 음반제작재 피 고 )는 新譜印稅制 가 시행되기 전에는저작자에게 곡비를 지급하고 음악저작자의 저작물을 이용하는 것이 거래관행으로 되어 있으므로 원고의 신탁계약에구애를 받지 않고 이 사건판결에서 다루고 있는 편집음반의 제작판 매 가 가능하다고 주장하였다. 논의의 쟁점은 곡비의 지급에 터 잡아 꾸려진 저작물 이용허락계약은 일정한 범위에서 신탁계약의 내용에 일정한 영향을 끼쳐 신탁계약을 어떻게 해석하는지에 관한 것이다. 이 글에서 곡비의 지급에 따른 저작물 이용허락계약과 신탁계약과의 관계에서 관련법리의 실체를 파악하고_ 이콜위하여 이 사건판결과 유사한 대법원 판결(대법원 2006. 12. 22. 선고 2006다21002 판결)에서 살펴보았던 내용을 비교함으로써 드러나는 신탁계약의 해석상 차이점을 밝혀 이 사건판결의 판시내용의 적용 또는 법리적 사항을 정리하고자 한다.

The economic return from copyright comes by means of license or assignment. The license in general is a kind of contract between a licensor and a licensee: an author and the producer of phonogram in producing work. Assignment results in a copyright transfer from a copyright assignor to an assignee: an author to a trustee upon a trust agreement. I f an author transferred copyright upon the trust agreement not to have any limitation o f legal effect, and also he were paid the ’Gogbee’16’ based on the license after the trust agreement, then would the producer of phonograms as a licensee exercise a certain right seemingly acquired from the author? With respect to this contractual issue, in the Gogbee Case, the Supreme Court has ruled that no matter when the producer o f phonograms had paid the money amount as Gogbee, he may exercise his own neighboring right acquired from an author. In legal reasoning, the Supreme Court acknowledges the custom in the musical publishing community which used to pay Gogbee for the interpretation o f unclear contractual context, even if the trust agreement preceded the license. However it contradicts a previous ruling of the Supreme Court, Trust Case(20이 Da60682). This article proposes that the trust agreement between an author and the Korean Music Copyright Association(KOMCA) without any contractual limitation should have priority over the copyright license based on the Gogbee payment. When the KOMCA holds the copyright which is transferred through the trust agreement, it is appropriate that the author be not entitled to exercise his own copyright any more.
