실질적 유사성 검증방법의 도입가능성

Applicable Possibility of Substantial Similarity Test in Korea

이 연구논문은 미국 판례에 의하여 개발된 ‘실질적 유사성 검증방법’을 분석하고 이 검증방법이 국내에서도 타당성이 있는가를 논증한 것이다. 이 검증방법에 대한 분석에 의하면 이 검증방법은 대륙법계의 추상적 심사방식과 구체적 심사방식을 저작물의 실질적 유사성 검증과 창작성의 검증에 도입한 것이거나 일반적인 사고형식에 불과하여 미국 고유의 것으로는 볼 수 없고 어느 나라에서나 적용 가능한 것으로 드러났다.

The purpose of this paper is to present that “Substantial Similarity Test” employed, developed by American judicial decisions can be regarded as appropriate in Korea or not. As a result of this analysis, it is proved that American judicial decisions have applied 41 appreciation in abstracto’ and ‘[appreciation in concreto’ of European civil law to similarity test between works and to creativity test of them, and that the test is only general way of thinking. The test is not proper to American case law only so that it is regarded as appropriate in every country.
