온라인 뉴스와 저작권

20세기말 등장한 정보통신기술(ICT) 혁명으로 인터넷은 여러 분야에 걸쳐 새로운 문화를 창조하고 있으며 인터넷 언론이 우리 생활에 끼친 영향 또한 예측할 수 없을 정도다. ICT의 발전 및 인터넷의 등장과 함께 저작권은 확장일로에 있으며 새로운 해석과 개념정립이 요구되고 있다. 일반적으로 저작권은 저작자의 지적 창작의 결과만 보호하는것이 아니라 그 결과물을 인류공동의 번영을 위해 사용하는 법 • 정책적 목표를 가지고 있으므로, 일정한 경우 공정사용으로서 일정한 요건에 따라 저작자의 허락 없이 이용하는 것이 인정된다. 인터넷 환경하에 저작권법은 제도적 기반을 제공하고 있다. 인터넷 언론 기사는 원칙적으로 해당 인터넷 언론에저작권이 귀속된다. 그러므로 해당 인터넷 언론의 동의를 받지 않고 인터넷 상에서 뉴스 또는 기사를 복사하여 출처를 밝히지 않은 채 다른 용도로 사용하는 것은 저작권 침해에 해당한다. 하지만 그것이 영리 목적이 아니고 출처를분명히 밝힐 경우 저작권법 위반으로 보기 힘들 것이다. 기자가 작성한 기사는 지배종속관계에서 단체명의 저작물로단체에게 저작권이 있다고 보아야 할 것이다. 포털사이트는 인터넷 언론과 계약을 맺고 인터넷 언론의 이름으로 뉴스를 전재한다. 이 경우 포털사이트는 단지전재계약을 맺었을 뿐이므로 저작권은 여전히 인터넷 언론에 있다고 보아야 할 것이다. 인터넷 언론에서 스크랩을하여 블로그에 글을 게시할 경우는 저작권자인 인터넷 언론의 복제권과 전송권을 침해하는 저작권 위반에 해당한다. 시민기자가 작성한 기사 자체가 제3자에 의하여 저작권 침해가 발생하면 시민기자가 저작권 침해를 주장할 수 있고, 시민기자가 작성한 기사의 묵음인 편집 자체를 복제하거나 전송하면 인터넷 언론도 편집저작물인 데이터베이스 저작권자로서 저작권 침해를 주장할 수 있다. 현실적 대안으로 제시되고 있는 온라인 뉴스 저작권 신탁방안도 그 미래가밝지만은 않다. 이 같은 문제를 해결하기 위해서는 법제도적인 측면과 기술적인 보호조치가 필요하다. 또한 저작권보호를 국제적으로 이어나갈 수 있어야 한다. 그리고 무엇보다도 타인의 저작물을 자신의 저작물과 동일시하고 그것을 허락 없이 사용하는 행위는 범죄라는 사회인식이 확립되어야 할 것이다.

Internet, which is in result of revolution of the information communications technology in end of the century, makes it possible to create new culture that no one could imagine before. Thanks to ICT and internet, copyright is supposed to enlarge its boundary and require new interpretation. Copyright is not only to protect the result of the creator, but also to use it for common prosperity. Under some condition, it is possible to use it fairly without consent of the creator. Copyright of news or article of the internet media belongs to the internet media. Basically, it is udawftil to copy news without consent of the internet media if it is used to other purpose and without citation. But it is difficult to say unlawful to copy without consent if it is used to non commercial purpose and in citation. It could be said that article which a reporter writes belongs to the media company. Portal site has no copyright because he contracts with internet media just only to transmit. It is the violation of copyright of the internet media if an individual download it at his own blog without consent. Independent reporter could appeal copyright to the violator if his article was copied without consent. It should be noted that an alternative, trust of online news copyright, is deemed to be dark. It requires legal the technical support to cope with that problem. In addition, it is needed international cooperation. First of all, it should be set up social perception that an act to copy without consent of the creator is deemed to crime.
