비영리민간단체지원법을 중심으로 살펴 본시민사회 활성화 정책 방안 연구

A Study of the Policy to Activate Civil Society: Focusing on Assistance for Non-Profit, Non-Government Organization Act

비영리민간단체의 발전과 시민사회 활성화를 위해서는 정부의 지원이 필요 하다. 특히 시민사회에 우호적인 법적 환경이 중요하다. 한국 사회에서도 1999년, 비영리민간단체의 자발적인 활동을 보장하고 건전한 민간단체로의 성장을 지원 하기 위한 비영리민간단체지원법이 제정되었다. 비영리민간단체지원법은 시민단 체의 활동을 보장하고 지원하는 것을 정부의 의무로 받아들였다는 점에서 큰 의의를 지니고 있으나, 애초에 시민사회가 요구했던 포괄적인 시민사회 활성화 입법의 수준에는 미치지 못하고 있다는 평가를 받고 있다. 또한 비영리민간단체지 원법에 규정된 지원 제도의 실효성이 낮고, 실제 운용과정에서도 정치적 편향성이 드러나 비영리민간단체들은 비영리민간단체지원법의 전면적인 개정이 필요하 다고 요구하고 있다. 향후 비영리민간단체지원법이 명실상부한 민간공익활동 및비영리민간단체의 조직과 활동에 관한 보편적 법 기능을 담보하기 위해서는 실질 적인 기본법적 위상을 확보할 필요가 있다. 통합성과 일관성, 형평성이라는 원칙 속에서 비영리민간단체의 자율성과 독립성을 보장하고, 지원의 실효성을 높이는 방향에서 비영리민간단체지원법 개정이 이루어져야 할 것이다. 다른 한편 특정 조직의 육성, 촉진만을 목적으로 한 여러 특별법에 대한 정비도 필요하다.

Government support is essential for the activation of civil society and the development of the non-profit private organizations. In particular, the favorable legal environment for civil society is important. In 1999, Assistance for Non-Profit, Non-Government Organization Act which is to promote public-interest activities of non-profit, non-governmental organizations by guaranteeing their voluntary activities and assisting their growth into sound civil organizations and to contribute to the development of a democratic society was established. However, this Act was being criticized in many respects and a sweeping change is needed. Assistance for Non-Profit, Non-Government Organization Act needed to be revised in the direction of ensuring the autonomy and independence of the non-profit, non-governmental organizations and increasing the effectiveness of government assistance. Also, fairness, integration and consistency are very important principle.
